The Analysis of Invalid Labor Contract System

Abstract

劳动合同的效力是劳动合同的核心问题,体现劳动合同的本质属性。由于劳动合同的特殊属性,使得劳动合同的效力问题在鉴于一般民事合同法理论的基础上,又有其自身的特点及价值取向。 在劳动法领域,立法者过多的考虑法律的引导功能,法律调整过于超前,对于劳动合同的生效要件规定过于严格,门槛太高。在确认无效劳动合同问题上,笔者认为应尽可能维护劳动合同的效力,尽可能维护劳动关系的稳定,除非认定合同有效不利于保护劳动者的合法权益、有损国家利益、社会公共利益或者他人利益。 本文除了前言和结语外,全文共分四大部分,第一部分是无效劳动合同制度的概述,内容包括:劳动合同的定义及特征、劳动合同的效力表现、无效劳动合同学界...The validity of the labor contract is the core problem of labor contract.
