劳动合同的效力是劳动合同的核心问题，体现劳动合同的本质属性。由于劳动合同的特殊属性，使得劳动合同的效力问题在鉴于一般民事合同法理论的基础上，又有其自身的特点及价值取向。 在劳动法领域，立法者过多的考虑法律的引导功能，法律调整过于超前，对于劳动合同的生效要件规定过于严格，门槛太高。在确认无效劳动合同问题上，笔者认为应尽可能维护劳动合同的效力，尽可能维护劳动关系的稳定，除非认定合同有效不利于保护劳动者的合法权益、有损国家利益、社会公共利益或者他人利益。 本文除了前言和结语外，全文共分四大部分，第一部分是无效劳动合同制度的概述，内容包括：劳动合同的定义及特征、劳动合同的效力表现、无效劳动合同学界...The validity of the labor contract is the core problem of labor contract.
