This research intended to know, study and
analysis on how the transfer of right to build (by trading) for settlement and the change to ownership
right in manifestation of legal certainly in Yogyakarta City and whether the transfer of right to build
(by trading) for settlement and the change to ownership right in manifestation of legal certainly in
Yogyakarta City. The method of research used was empirical legal research using qualitative data
analysis method by inductive reasoning method. Based on result of this research the transfer of right
to build (by trading) for settlement and the change to ownership right by using authentic certificate
established by land certificate Issuer Official as basic of data change on land registry to land office.
In practice the transfer of right to build (by trading) for settlement has been manifest legal certainty
in Yogyakarta City. It can be seen from 15 respondents buyers, all respondents register right to build
for settlement to the Land Office to note the transfer of those rights in the land book and a list of
the issuance of certificates and other public right of build on behalf of the new rights holder. The
change of right to build into ownership right has not manifest legal certainty because of the 15
respondents, only four respondents who apply changes for the right to build for settlement into
ownership right. Application for change of right to build into ownership right submitted to the Head
of the Land Office Yogyakarta City, after granting of the application is recorded voidance right to
build in certificates, books and a list of other public land, registered with the former ownership right
to build in the land book, certificate and a list of public other ownership right and the issuance of the
certificate on behalf of the new rights holders
