O presente trabalho visa apontar o entendimento e o tratamento do Direito Penal brasileiro em relação aos indivíduos diagnosticados com algum tipo de doença mental e/ou portadores do transtorno do espectro autista e como os diferentes tipos de sanções admitidas pelo ordenamento jurídico podem e devem se adequar a cada caso concreto. O enfoque é no dever do respeito, cuidado e atenção às diferentes condições e formas de enxergar o mundo que são estudadas rotineiramente pelos operadores do DireitoThe current work aims to analyze and explore the Brazilian Criminal Law’s perspective and understanding related to individuals who have been diagnosed with a mental disorder of any kind and origin, besides the people on the Autism Spectrum Disorder, the different kinds of sanctions admitted by the legal system and how do they must me able to adapt to each concrete case.
