Abstract

The essay analyzes the Italian Costitutional Court decision n. 194/2018, which has ruled that art. 3, para. 1, of the so called “Jobs Act” (Legislative Decree n. 23/2015) is uncostitutional because of the rigid and incongrous calculation method of the “indemnity” due to the employee unfairly dismissed. According to art. 3, para. 1, of the “Jobs Act” the “indemnity” consisted of 2 monthly wage for each year of seniority of the employee (between the minimum of 6 and the maximum of 36 monthly salary). According to the Italian Constitutional Court this method of calculation is uncostitutional under both the Domestic (art. 3, 4 and 35 of Italian Constitution) and the International law (art. 24 of the European Social Charter), because it is not “adequate” either to restore the effective damages suffered by the employee or to prevent the employer from unfair dismissals. The Author agrees with the Constitutional Court decision, but believes that it should have explained why on the contrary the maximum limit of the indemnity (36 monthly wage) complies with the Italian Constitution and with art. 24 of the European Social Charter. Finally the Author underlines that the decision n. 194/2018 does not only reshape the protections granted to the employee by the “Jobs Act”, but it could affect the entire Italian protection System in case of unfair dismissal
