This article aims to present the process for choosing members of the Tutelary Council as an instrument of participatory democracy for the realization of the rights and guarantees of children and adolescents. To this end, the methodology is qualitative, bibliographic and normative, using doctrine, and quantitative, based on the use of statistical data regarding the process for choosing members of the Tutelary Council in 2015 and data from complaints of Disque 100. First, presents the social, legal and political changes for children and adolescents with the advent of the doctrine of integral protection. Then, it discusses the role of the Tutelary Council in the Rights Guarantee System, with attributions and duties provided by Children and Adolescent’s Statute. It explains the process for choosing members of the Tutelary Council, concluding by the importance of strengthening participatory democracy through the Tutelary Council in view of its fundamental role in defending the rights of children and adolescents.O presente artigo objetiva apresentar o processo de escolha dos membros do Conselho Tutelar como um instrumento de democracia participativa para efetivação dos direitos e garantias da criança e do adolescente. Para tanto, a metodologia abordada é de natureza qualitativa, bibliográfica e normativa, com a utilização de doutrina, e de natureza quantitativa, a partir da utilização de dados estatísticos referentes ao processo de escolha dos membros do Conselho Tutelar em 2015 e das denúncias do Disque 100. Primeiramente, apresenta-se as mudanças sociais, jurídicas e políticas com relação a crianças e adolescentes com o advento da doutrina da proteção integral. Em seguida, discorre-se sobre o papel do Conselho Tutelar no Sistema de Garantia de Direitos, com atribuições e deveres previstos no Estatuto da Criança e do Adolescente. Por fim, explica-se o processo de escolha de membros do Conselho Tutelar, concluindo-se pela importância do fortalecimento da democracia participativa através do Conselho Tutelar diante do seu papel fundamental na defesa dos direitos das crianças e dos adolescentes
