A Citizens‘ Attempt to Solve the Polish ConstitutionalCrisis verfassungsblog.de /a-citizens-attempt-to-solve-the-polish-constitutional-crisis/Jarosław Marciniak , Christian Boulanger Do 30 Jun 2016Responding to severe criticism, from inside and outside of Poland, concerning the disempowerment of the PolishConstitutional Tribunal (see, for example here, here and here on this blog), the governing „Law and Justice“Party (PiS) is currently working on a new law on the Constitutional Tribunal. Expecting that PiS does not intendto use this new law to solve the severe constitutional crisis that the party has created, Polish civil society groupshave drafted an alternative bill regarding the Act on the Constitutional Tribunal. The bill was launched asa popular initiative and  received the prescribed number of supporting signatures.  On June 9th 2016, a BoardMember of the Committee for the Defence of Democracy (KOD), Jarosław Marciniak, presented the bill beforethe Sejm – the lower house of Polish Parliament. It was included – on short notice – in the parliamentary agendaalong with the bill proposed by PiS, and another one proposed by the Polish People’ Party (PSL). Rarely, if ever,have we seen an Act on the Constitutional Court being proposed by popular initiative. What follows is the text ofthe speech presenting both the initiative and the bill itself, in order to document an extraordinary initiative of civicengagement in constitutional politics. Not surprisingly, PiS did not adopt or even consider the popular initiative’sbill, in spite of its being allegedly examined simultaneously with PiS’s bill by the Parliamentary Commission forJustice and Human Rights (Thanks to Bartosz Marciniak (EUI, Florence) for providing the text and information onthe matter).Honorable Marshal, Honorable members of the House!As a Polish citizen, standing in this distinguished place, I wonder, what has happened? What has happened thatPoles need to defend the Constitutional Tribunal? To defend the Constitutional Tribunal from their ownrepresentatives? The representatives who when taking up their honorable office pledged – often invoking God –to observe and abide by the Constitution.No one expected that the attempts to paralyze the Constitutional Tribunal would cause the nation to unite todefend that for which our grandparents, parents, and often ourselves fought for almost 50 years: freedom.As every citizen aware of her rights knows, we must remain servants of the law in order to be free. Everyoneaware of her rights knows that freedom does not exist without the rule of law – and the rule of law does not existwithout the Constitutional Tribunal functioning effectively.In a democratic state governed by the rule of law, those who put themselves above the law put themselvesabove the equality and freedom of citizens. Those who in a democratic state governed by the rule of law areafraid of judges, of the Constitutional Tribunal, and of the rule of law itself certainly do not have good intentions.On the other hand, those who have best interests of Poland at heart are “aware of the need for cooperation withall countries for the good of the Human Family” [I am quoting an excerpt from the Polish Constitution’s preamble,as one might think that it has been forgotten here]. To repeat: those who have best interests of Poland at heartand are “aware of the need for cooperation with all countries for the good of the Human Family” would not attackthe rule of law, of which the Constitutional Tribunal is the guardian.There are principles that this House – with all of its majesty and power – cannot do away with, even byamending the Constitution itself. These principles stem from the dignity inherent in each human being. Theseare the principles upon which freedom and equality are founded. These are the principles which groupsbordering on fascism and the cult of force would like to defy. Such groups are constantly rising in numbers inPoland.Honorable Speaker of the House, Honorable Members – let us show that our intentions are good.1/4All of Europe, the entire world is now looking at Poland. With the rising wave of nationalism, with the rising wavesof hatred towards everything that is not homogeneous, we hope that you, Honorable Members, will act as rolemodels for others once again. All that is needed is your good will to rectify the deplorable situation as a result ofwhich both Poland, as a country, and Poles, as a nation, could greatly suffer.Speaker of the House, Honorable Members!I shall not recount the constitutional crisis which we are witnessing. Practically everything has been said on thematter both in Poland and abroad. I shall not recount facts or their interpretations – facts and interpretations thatall Poles have heard from the left, the center, and the right side of the political scene.I come here on behalf of the citizens represented by you. Speaker of the House, Honorable Members! Time is ofthe essence. As a citizen appearing before you on behalf of other citizens, I believe – and I hope you believe sotoo – that in the current political and international situation, Poland must resolve the ongoing constitutional crisisimmediately. The right moment will come for an honest assessment of the current situation. Now, however, it istime for action.It is your duty as the Members of the Polish Parliament to resolve the crisis. We, the citizens, are coming heretoday with an olive branch: with a bill which could be approved once the oath of office has been accepted fromthe lawfully appointed judges and once the outstanding judgements by the Tribunal have been published.The solution of the ongoing constitutional crisis cannot be based on a political consensus only. The ending of thecrisis must first and foremost be delivered through following the letter of the law and by restoring theConstitutional Tribunal to its rightful position of legal and civic authority.The Committee for the Defence of Democracy (KOD) was established in response to the attempts to paralyzethe Constitutional Tribunal. The Committee is a public forum that allows all Polish citizens to make their voiceheard. I appear here on behalf of those citizens who have the common good of Poland in their hearts.Honorable Members! We, the citizens, understand the importance, the role, and the meaning of the principlesupon which a democratic state is founded. We also understand the role and the meaning of constitutional justice.It is not without reason that constitutional justice developed as a result of the tragedy of the two World Wars – inreaction to horrific atrocities committed at that time. Constitutional justice is a legal and judiciary mechanism.This mechanism guarantees that democracy will never become a cult of force, where those of different skincolor, of different religion or sexual orientation are no longer treated as human beings but become mere objectsof the state. The constitutional courts of Europe are there to ensure that Europeans will never again be able to –against all human nature – commit these horrific atrocities with which the history of the twentieth centuryabounds. Constitutional justice is one of the greatest achievements of the European political and legal culture. Itis an achievement that we, Poles, are and should be proud of.For decades we envied Western Europe its economic, societal and civilizational developments. Yet now, afterdecades of oppression, we too have achievements that we can be proud of. Achievements that we should beproud of!Honorable Members, do you know that one of the achievements that is admired across Europe and all over theworld is the case law of a small Tribunal from Warsaw? The decisions of the Tribunal, which consists of just a fewjudges, are respected before European High Courts and other constitutional courts both in Europe and beyond.But the jurisprudence of the Polish Constitutional Tribunal is not only quoted and analyzed by lawyers. Thejurisprudence of OUR Tribunal has – first and foremost – truly changed the lives of millions of Poles since 1989.It is jurisprudence that helped shape the Polish legal and social system. A system that should safeguard thefreedoms and rights of a man and citizen. It is a jurisprudence that guarantees that no power – not evenlegislative power elected in universal suffrage – shall violate the fundamental rights of the citizens of Poland. It isa jurisprudence that stands as a foundation of the Republic of Poland – shaped and developed through decadesof common effort by free people.2/4The Polish Constitutional Tribunal developed jurisprudence of which we should be proud, which we shouldpublicize and adhere to out of a patriotic duty.I therefore ask you – Honorable Members – I ask you to protect what all our great lawyers and authorities suchas: Ewa Łętowska, Andrzej Zoll, Teresa Liszcz, Marek Safjan, Wojciech Hermeliński, Mirosław Wyrzykowski,Jerzy Stępień, Lech Garlicki, Biruta Lewaszkiewicz-Petrykowska, Janina Zakrzewska, Zdzisław Czeszejko-Sochacki, as well as many other outstanding Polish judges of the Constitutional Tribunal have built over the last30 years.Honorable Speaker of the House, Honorable Members!Citizens associated with KOD, citizens who share KOD’s ideas as well as citizens who are not keen to or areindifferent towards KOD – they all decided to exercise their democratic right. The discussion on the bill of the Acton the Constitutional Tribunal, held today, is a result of this decision. There is only one, noble, purpose to ourproposal – a purpose which this House appears to have forgotten. This purpose is to fulfill the provisions of theConstitution of the Republic of Poland and to end the constitutional crisis. The aim of our proposal is to enforcethe verdicts of the Tribunal and to guarantee their future enforcement by all institutions of the government.Moreover, the bill equips the Tribunal with an effective procedural mechanism – already enshrined in the Act onthe Constitutional Tribunal of 25 June 2015. By virtue of the bill’s provisions, the Tribunal will be in position toonce again fulfill its constitutional obligations – most importantly to perform the constitutional review of lawsproduced by the Parliament.Honorable Members! The bill we advocate not only fulfills the norms enshrined in the Constitution, but also – tothe extent permitted by the Constitution – it introduces solutions which the ruling party sought to implement inthe Act on the Constitutional Tribunal. All the solutions which, as we would like to believe, reflect a concern tomake the Tribunal more efficient.For these reasons the bill on the Act on the Constitutional Tribunal presented by KOD proposes inter alia:1. the reinstatement of the Act of 25 June 2015 on the Constitutional Tribunal ;2. the right to propose candidates to the Tribunal exercised by the President of the Republic, the Sejm, theNational Council of the Judiciary, the Supreme Court, and the Supreme Administrative Court;3. the appointment of new justices of the Tribunal by the 2/3 majority of votes in the presence of at least halfof the legislative number of the Members of Sejm;4. the introduction of an anti-deadlock mechanism according to which a justice whose term of office hasexpired shall be entrusted with performing her judiciary functions until a new justice is lawfully appointed.The aim of this mechanism is to avoid paralyzing the Tribunal should the Sejm be unable to appoint a newjustice. On the national level, a similar mechanism has been introduced to the appointment procedure ofthe Polish Ombudsman. On the European level, a similar mechanism operates with regards to theappointment of justices of the Court of Justice of the European Union; and5. the swearing-in of a newly-appointed justice before the Marshal of the Sejm during the same session inwhich that justice was appointed.Honorable Members!I would like to emphasize – and I hope that you bear this in mind by voting on the bill in accordance with yourconscience and will – that the bill before you fulfills all the requirements proposed by the Venice Commission inits report on the Polish constitutional crisis. If you truly claim that it is your goal to avert the constitutional crisis, ifyou wish for Poland to cease being a problematic country within the free world – do accept this bill as soon aspossible. The international community will truly respect such a decision. The Law and Justice party has promisedto listen to the Polish people. We trust that you will keep this promise.I would also like to emphasize that neither the bill nor these legislative proceedings in ANY WAY eliminateliability for violating the Constitution – as is now the case with respect to the President of the Republic of Poland,3/4Mr. Andrzej Duda, and to the Prime Minister, Mrs. Beata Szydło. Moreover, I need to emphasize that thislegislative proceeding must not become a smoke-screen from the European Commission nor become a fig-leafcovering up the lack of a real dialogue. From this honorable place in which I am standing, on behalf of the Polishnation, I demand that you, Honorable Members of this House, fulfill the obligations imposed upon you by yoursovereign through the Constitution, to which you are subject, like all members of this nation.In order to conclude, I shall take the liberty of quoting an excerpt from one of the Constitutional Court’s milestonedecisions. On behalf of the citizens I implore that you take it to heart. For we should all remember that principlesof separation and balance of powers are the foundation of a democratic state governed by the rule of law. TheConstitutional Tribunal is their guardian. These principles,‘were devised in order to avoid the experience of the past. This experience relates to a risk as wellas to a real danger of a simplistic understanding of democracy – chiefly if not exclusively as theomnipotence of the parliamentary majority. In order to avoid this danger, the system ofconstitutional democracy was created, which the Constitution of Poland of 1997 fully implements’.The Constitutional Tribunal is the foundation of this system.Honorable Members of this House! Let us restore normalcy again.To destroy law with politics is easy.
