“De-constitutionalism” in Turkey? verfassungsblog.de /de-constitutionalism-in-turkey/Ali Acar Do 19 Mai 2016Can “de-” be a modifier to describe the constitutionalism in a country? [1]This is what Prof. Kemal Gözler, a constitutional law scholar, has termed the current state of constitutionalism inTurkey.[2] He argues that Turkey undergoes a process of de-constitutionalism through various ways andpractices of constitutional bad faith, referring to David Pozen’s recent article published in Harvard LawReview.[3] His argument is that constitutional bad faith practices employed by the constitutional institutions(mainly the executive, but also the judiciary) lead one to hold the view that there is no more a (valid) constitutionin Turkey.More clearly, Gözler argues that the basic principles of constitutionalism–such as the separation of powers, theindependence of judiciary, the protection of fundamental rights and freedoms–do not hold true anymore inTurkey. Mark Tushnet’s Editorial remarks in the last issue of I*CON that “studying the power maps involvesstudying constitutions in authoritarian nations, but perhaps not studying constitutionalism there”[4] can beregarded along the lines of the Gözler’s analysis. Or the state of constitutionalism in Turkey can be studied as anexample of abusive constitutionalism, with reference to David Landau.[5]Whatever it is termed, one thing is certain that Turkey is undergoing a constitutional deadlock or crisis, and itsindicators can be observed on many occasions.After the failure of the constitution-making process under the previous Parliament’s term of office (June 2011 –July 2015), a new initiative was set in motion following the election held on November 1, 2015. To this effect, aConstitutional (Reconciliation) Commission was created in the Parliament. The Commission was composed, asin the previous example, of three members from each of the four political parties sitting in the Parliament andpresided by the Speaker of the Parliament. However, this attempt too failed because the Commission wasdissolved shortly after its establishment.[6]The reason why the Commission could not carry on its task changes from one political party to another. Themost important reason, on which the main opposition party–the Republican People’s Party (CHP)–relies, is theruling Pro-Islamic Justice and Development Party (AKP)’s insistence on presidentialism. In the CHP’s view,presidentialism cannot be a system choice for Turkey, thus it cannot be accepted. The AKP, on the other hand,argues that every system alternatives, including presidentialism, could be debated in the Commission withoutany precondition, but the CHP hindered this discussion. The far-right Nationalist Movement Party (MHP) and theleft-wing, Pro-Kurdish, Peoples’ Democratic Party (HDP) seem to share the CHP’s reason–albeit in differentdegrees–but also have their owns.Although presidentialism was the main challenge for the Commission, it was not the only one. The politicalparties did not agree either on whether the Parliament could pass a new constitution in the technical sense of theterm. The CHP and the MHP believe (though the latter is not very clear on this) that the Parliament is bound bythe unamendable rules (referring to the first four articles of the Constitution). The AKP seems not to care aboutthe CHP (and MHP)’s position. It appears that the Constitutional Court may be appealed to as the final arbiter tosolve this matter, if such a constitution ignoring the unamendable rules is accepted. This type of situation willobviously put the Court in the middle of a legal and political turmoil, once again. [7]The current phase of the constitutional crisis may render constitutionalism meaningless altogether in Turkeygiven that the ruling party alone is now drafting either a new constitution or a large scale constitutionalamendment.[8] However, this is clearly in contradiction with the very idea of a constitution; i.e. a (legal as well asa political) text to be agreed on or consented by, at least, more than simple majority of the society, for a stableand durable functioning.1/4The statements made by the representatives of the AKP involved in the drafting process give the idea that theAKP will insist, by all means, on enacting a new constitution endorsing a presidential system, the details ofwhich are not clear yet. The ruling party falls short only of (the support of) 14 MPs to achieve its aim. If theconstitution is accepted in the Parliament by at least 330 MPs, but less than 367, then it has to be submitted to areferendum, which is obligatory according to the Amendment Rule (Art. 175). The possible rejection of the AKP’sconstitution, as well as its acceptance in the referendum, seems not to stop the constitutional struggle in Turkey;quite the opposite, it may exacerbate it.Nevertheless, politicians are very creative to overcome the crisis, or get rid of the impasse. For example,according to an AKP MP, who himself is a lawyer and the head of the Justice Commission at the Parliament, theParliament can abolish, within the scope of its constituent power, the entire existing-constitution. The MP, Ahmetİyimaya, has stated the following:Abolishing the current constitution, which is within the scope of the constituent power of theParliament, is more important than making a new one. And indeed, this will be a real achievementfor the democracy. We may have to live without a constitution for 2 or 3 or 5 years, but rememberthat we will still have (organic) laws and constitutional institutions after we abolish the currentconstitution. Nevertheless, what is a more rational choice is put into force the new constitutionconcomitantly with abolishing the already-existing one.[9]This statement should be taken seriously, as it seems to suggest an alternative way (or a solution!) to end thecrisis, if the AKP fails to obtain the qualified majority necessary to pass a (new) constitution in theParliament.[10]Another indicator that Turkey is undergoing a constitutional crisis is the recent attempt to lift the immunity of MPsby way of a constitutional amendment proposed by the AKP. The target of the proposal appears to be the HPD’sMPs.[11] It has been approved by the sub-commission and will be on the agenda of the General Assembly soon.The MHP unsurprisingly takes side with the AKP since the issue turns out to be on a patriotic matter. However,the proposal is supported by the CHP as well. But paradoxically enough, the same CHP argues that the proposalis contradictory to the Constitution.A number of constitutional law scholars also expressed their views that the amendment proposal is contrary tothe Constitution, since, the argument goes, the proposal aims to lift the immunity of certain MPs only and for acertain period of time. According to the Rules of Procedure of the Parliament, an MP has the right to defendhimself before the Parliament during the debates, and Article 85 of the Constitution stipulates that an MP canbring the decision of Parliament lifting the immunity before the Constitutional Court. However, the proposal inquestion takes away these rights; thus, it is unconstitutional. Furthermore, the proposal is against the basicprinciples of criminal law incorporated in the Constitution, as the proposal will have an ex-post facto effect. [12]It seems that this proposal will be, most probably, passed by the Parliament. When it is signed into law by thePresident, (or if it is approved in the referendum, when it has to be submitted to one), it will be possibly broughtbefore the Constitutional Court by way of individual complaint mechanism. The Court will be harshly criticizedhowever it rules in this possible case.The result of all these situations is that any new constitution enacted under these conditions in Turkey willunlikely survive, or such a constitution will not possibly maintain functioning government in a stable way. It is notdifficult to predict that a different majority composition of a future Parliament will try to amend, change or evenabolish such a constitution. This is almost inevitable due to the politically divided and polarized condition of thesociety.[13]Constitutional politics/law will be at the top of the agenda in Turkey in the short, medium and probably longterms. The crisis or deadlock, whatever it is termed, seems to continue, and the Constitutional Court will play acritical role in this picture.2/4Update: This post was first sent to the Editors on May 7. Therefore, some points and facts need to be updated.The first point is that although the CHP had declared that they would support the proposal and in fact did so inthe sub-commission, the first round of the vote in the General Assembly has demonstrated that the majority ofCHP’s MPs did not vote for the proposal. The result of the first round indicates that the amendment may have tobe submitted a referendum, as the total number of votes in favor of the proposal was below 367; this requires theamendment to be submitted to a referendum. However, if the CHP had voted for the proposal, the referendumwould not be the issue.The second point is that although the original remark in the Post that the amendment may be challenged beforethe Constitutional Court through individual (constitutional) complaint mechanism still holds, the first round of thevote hints that the amendment may be challenged before the Constitutional Court by an application of 110 MPs.The first round of the vote allows inferring this conclusion, which would be otherwise – i.e. should the CHP,institutionally, had supported the amendment – not possible.
