Life is not static, there are constant advents which make society to alter and modify itself. With the advances of technology and bioethics the doors for the development and enhancement of the human body have opened for the so called – technological trans-humanism. This philosophic movement stands for the presence of anthroptechnique for the enhancement of physical and psychological features, producing and creating beings infused with technology. Through this trans-humanism notion, we ask: are the human and fundamental rights to be protected or trespassed? The answer points out to this question which is integrated, methodologically, in a paradoxical, ambiguous and ambivalent perspective, regarding that the human rights, along with fundamental rights are the foundation of a society based upon democracy and equality among the people.A vida não é estática, um constante devir faz com que a sociedade se altere, se modifique. Com o avanço da tecnologia e da biotécnica abriram-se portas para o desenvolvimento e aprimoramento do corpo humano - o transumanismo tecnológico. Essa corrente filosófica defende que a antropotécnica está presente e deve ser usada para aprimorar tanto o corpo físico, como o psicológico, produzindo e criando seres permeados de tecnologia. Diante dessa inserção do transumanismo, pergunta-se: os Direitos Humanos e Fundamentais serão protegidos ou transgredidos? A resposta que se aponta para esta questão integra, metodologicamente, uma perspectiva paradoxal, ambígua e ambivalente, tendo em vista que os Direitos Humanos, bem como os Direitos Fundamentais, são o alicerce de uma sociedade que preza pela democracia e igualdade entre as pessoas
