THE REPRESENTATIVE OF THE UNITED STATES OF AMERICA TO THE UNITED NATIONS April 12, 1993 Dear Professor Bassiouni: I would like to invite you to participate in a meeting of experts that I plan to convene to discuss the forthcoming charter for a War Crimes Tribunal on the former Yugoslavia. Given the unprecedented step that the United Nations is taking to establish this international tribunal to prosecute persons responsible for war crimes and other serious violations of international humanitarian law, I want to tap your expertise in reviewing and commenting on the relevant documents. A s  I said in the Security council chamber on February 22nd when Resolution No. 808 was adopted, "There is an echo in this chamber today. The Nuremberg principles have been reaffirmed. We have preserved the long-neglected compact made by the community of civilized nations 48 years ago in San ~rancisco: to create the United Nations and enforce the Nuremberg principles. The lesson that we are all accountable to international law may have finally taken hold in our collective memory.I1 We have to work hard to see that the lesson I have spoken of continues to take hold in our collective memory and collective action in the months and years ahead. The U.S. Government is firmly committed to seeing that the war crimes tribunal is established and that it functions effectively. Your advice is an important part of that commitment. Professor M. Cherif Bassiouni College of Law DePaul University 25 East Jackson Blvd. Chicago, Illinois 60604-2287 The UN Office of Legal Affairs is currently preparing a report for the Security Council that will examine all aspects of implementation of Resolution No. 808. The United States, France, Italy, the United Kingdom, and the CSCE have submitted to the UN Legal Counsel written comments which are being considered at this time. When it is issued, about the 22nd of April, the UN report should provide the basis for agreement on a charter for the tribunal and a means to create it. We would plan to convene our meeting a few days later, probably April 30th. I am enclosing the CSCE, French, Italian, and U.S. comments (including draft charters) that the UN is now reviewing. We would appreciate any comments in writing that you would like to provide us with prior to issuance of the UN report. Following release of the UN report, we will convene the meeting of experts, including yourself, and government lawyers to examine the UN report and discuss its merits. We expect that the meeting will take place in Washington. We will provide you with a copy of the UN report immediately upon its release.
