[ES] Este trabajo aborda el concepto y tratamiento jurídico de la tortura, con un enfoque en su regulación nacional e internacional. Se explora la definición de tortura, distinguiéndola de otros actos de sufrimiento infligidos por particulares, y se enfatiza la participación del Estado en estos actos. El análisis abarca desde la delimitación del concepto de tortura hasta su tipificación en el CP español, destacando la evolución normativa y las deficiencias históricas en la protección de la dignidad humana y la integridad moral. Se examinan los elementos esenciales del delito de tortura, incluyendo el componente material, la cualificación del sujeto activo, y el elemento teleológico. Además, se aborda la protección del bien jurídico de la dignidad humana y la integridad moral, y se detallan las características del delito, tales como su naturaleza dolosa y de tendencia. Asimismo, el trabajo analiza las posibles justificaciones de la tortura en casos extremos, discutiendo las posturas doctrinales respecto a la aplicación de causas de justificación, como la legítima defensa y el estado de necesidad. Finalmente, se presentan ejemplos prácticos de la casuística de la tortura en España y se evalúan los argumentos a favor y en contra de su justificación en situaciones de emergencia.[EN] This work thoroughly examines the concept and legal framework of torture, with a focus on its regulation at both national and international levels. It explores the definition of torture, differentiating it from other acts of suffering inflicted by private individuals, and emphasizes the involvement of the State in these acts. The analysis covers the delimitation of the concept of torture and its codification in the spanish Penal Code, highlighting the normative evolution and historical shortcomings in the protection of human dignity and moral integrity.The essential elements of the crime of torture are scrutinized, including the material component, the qualification of the perpetrator as a public official, and the teleological element. Additionally, the thesis addresses the protection of the legal interests of human dignity and moral integrity, detailing the characteristics of the crime, such as its intentional and tendency-based nature. Moreover, this work analyzes the potential justifications for acts of torture in extreme cases, discussing doctrinal positions regarding the application of justifying causes, such as self-defense and the state of necessity. Finally, practical examples of the occurrence of torture in Spain are presented, evaluating the arguments for and against its justification in emergency scenarios
