IMPLEMENTASI RESTORATIVE JUSTICE TERHADAP TINDAK PIDANA ASUSILA MELALUI MEDIA SOSIAL DI WILAYAH HUKUM POLDA DIY

Abstract

The development of information technology has changed societal interactions, with social media becoming a new public space. However, this digital space also brings issues like indecent crimes in D.I. Yogyakarta. The police responded with Circular Letter Number: SE/2/II/2021 to encourage responsible use of digital space and introduce Restorative Justice (RJ), which focuses on restoring relationships between perpetrators, victims, and the community. However, the application of RJ in digital indecency cases is still limited, with only 2 cases resolved through RJ from 2021-2024. This research uses a normative-empirical approach, gathering facts from field research at Polda D.I. Yogyakarta. The implementation of RJ starts from victim reports and involves the agreement of both parties to settle amicably through a request letter, a peace agreement, and evidence of rights restoration. Challenges in implementing RJ include unknown perpetrators, lack of understanding among involved parties, and disagreements. Efforts to overcome these challenges include digital data analysis, collaboration with law enforcement, community education, providing information about RJ, and building trust and communication between both parties
