ANALISIS YURIDIS SOSIOLOGIS EFEKTIVITAS PENERAPAN RESTORATIVE JUSTICE DALAM PENYELESAIAN TINDAK PIDANA KEKERASAN DALAM RUMAH TANGGA DI TINGKAT KEPOLISIAN

Restorative justice is a case resolution that focuses on direct participation between the perpetrator, victim and the community. Not all criminal acts must be pursued through a trial process. Approach restorative justice can be applied in the law enforcement process so that it will answer various problems in law enforcement in cases of domestic violence which have not yet reflected the principles of justice as the aim of the law. This research was conducted to determine and analyze the factors that influence implementation Restorative Justice and the efforts made by the Gresik Police to increase the effectiveness of implementation Restorative justice in resolving domestic violence cases in Gresik Regency. The type of research used in this writing is sociological juridical research, with research that aims to obtain legal knowledge empirically by going directly into the object. Then it results in the conclusion that there are five factors that influence law enforcement, where These five factors can be said to be effective in influencing implementation Restorative Justice in resolving acts of domestic violence in the jurisdiction of the Gresik Police and there are five efforts, namely pre-emptive, preventive, repressive, curative and rehabilitative efforts carried out by the Gresik Police to increase the effectiveness of implementation.Restorative Justice in resolving acts of domestic violence in Gresik Regency
