Costituzionalismo europeo del digitale e governance dell'infosfera

Abstract

The utopian nature of the infosphere has by now been supplanted by the data economy. If not properly governed, data economy is able to degrade the contemporary constitutional State. In the Euro-unitary context, we are witnessing the emergence of a European digital constitutionalism, I maintain. Digital constitutionalism emerged as a concept thanks to the cooperation of dogmatic, jurisdictional, and normative factors. However, how can the fundamental principles of constitutionalism be ensured in practice in the cyberspace? A European network of ad hoc independent administrative authorities seems in this sense the most appropriate governance model to ensure the survival of constitutionalism in the Third Millennium
