In this work, an overview of Brazil, Germany and Austria is established to carry out a study of fundamental social rights, with the purpose of answering two great questionings: are social rights fundamental rights constitutionally guaranteed? Are fundamental social rights understood as subjective (individual) rights and/or just in the order of objective rights? To object such issues, the deductive method, the analytical procedure and the bibliographical and jurisprudential research technique are used. We aim to contribute to a better understanding of fundamental social rights and the visualization of contested theoretical aspects related to the theme, considering the overview here proposed, so that, from this study, we may progress in the comprehension, implementation and guarantee of these rights.Nesse trabalho, estabelece-se um panorama entre o Brasil, a Alemanha e a Áustria para realizar um estudo dos direitos fundamentais sociais, com o fim de responder dois grandes questionamentos: os direitos sociais são direitos fundamentais garantidos constitucionalmente? Os direitos (fundamentais) sociais são compreendidos como direitos subjetivos (individuais) e/ou apenas na ordem de direito objetivo? Para objetar tais problemáticas, utiliza-se o método dedutivo, o procedimento analítico e a técnica de pesquisa bibliográfica e jurisprudencial. Pretende-se contribuir para uma melhor compreensão dos direitos fundamentais sociais e a visualização de aspectos teóricos controvertidos relacionados ao tema, tendo em vista o panorama aqui proposto, para que, a partir desse ensaio, possa avançar-se na compreensão, efetivação e garantia desses direitos
