ИССЛЕДОВАНИЕ СВИДЕТЕЛЬСКИХ ПОКАЗАНИЙ И ДРУГИХ «НЕОБЪЕКТИВНЫХ» ДАННЫХ ПРИ ПРОВЕДЕНИИ ЭКСПЕРТИЗ ПО ФАКТАМ НЕБЛАГОПРИЯТНЫХ ИСХОДОВ ОКАЗАНИЯ МЕДИЦИНСКОЙ ПОМОЩИ

Abstract

The completeness of the investigation of the case materials is a fundamental feature of forensic examination. Within the framework of the iatrogenic cases, the range of research objects includes not only medical, but also other documents containing the testimony of eyewitnesses of events, including medical workers. At the same time, the verification of the reliability of witness testimony is not within the competence of experts, which does not exclude the expert evaluation of various versions and the application of the special knowledge of the members of the expert commission to the information obtained from the testimony. A study of the materials of criminal and civil cases based on content analysis was conducted, the results of which established the limits of expert competence when working with procedural documents, and also studied the possibilities of obtaining data from such documents that are suitable and useful for forensic medical assessment of an unfavorable outcome of medical care.Полнота исследования материалов дела является основополагающим признаком судебной экспертизы. В рамках СМЭ по «ятрогенным» делам в круг объектов исследования входят не только медицинские, но также и иные документы, содержащие показания очевидцев событий, включая медицинских работников. Вместе с тем проверка достоверности свидетельских показаний не входит в компетенцию экспертов, что не исключает экспертной оценки различных версий и применения специальных знаний членов экспертной комиссии к информации, полученной из показаний. Проведено исследование материалов уголовных и гражданских дел на основе контент-анализа, по результатам которого установлены пределы экспертной компетенции при работе с процессуальными документами, а также изучены возможности получения из таких документов данных, пригодных и полезных для судебно-медицинской оценки неблагоприятного исхода оказания медицинской помощи
