Protection of personal rights of legal persons

Abstract

Niniejsza praca magisterska poświęcona jest problematyce ochrony dóbr osobistych osób prawnych i składa się z czterech rozdziałów. W założeniu ma ona na celu scharakteryzowanie reżimu ochrony dóbr osobistych osób prawnych w oparciu o przepisy Kodeksu cywilnego, jak i przepisów pozakodeksowych. Pierwszy rozdział jest poświęcony przybliżeniu kluczowych z punktu widzenia niniejszej pracy pojęć jakimi są dobro osobiste i osoba prawna. Zagadnieniem rozdziału drugiego jest problematyka zakresu podmiotowego i przedmiotowego ochrony dóbr osobistych osób prawnych. W ramach pierwszej części rozdziału, scharakteryzowane zostały rodzaje podmiotów, których dobra osobiste podlegają ochronie. Druga część rozdziału ma na celu rozważenie problematyki odpowiedniego stosowania przepisów o ochronie dóbr osobistych osób fizycznych w stosunku do osób prawnych, oraz scharakteryzowanie wybranych przykładów dóbr osobistych osób prawnych. Rozdział trzeci poświęcony jest charakterystyce roszczeń przysługujących w celu ochrony dóbr osobistych, w tym roszczeń przysługujących w przypadku naruszenia prawa do firmy. Rozdział czwarty jest zestawieniem reżimów ochrony dóbr osobistych osób prawnych poza Kodeksem cywilnym. W ramach zestawienia, zostały poddane analizie środki ochrony przysługujące na podstawie ustawy o zwalczaniu nieuczciwej konkurencji, ustawy prawo własności przemysłowej, czy też Kodeksu postępowania cywilnego.This master's thesis is devoted to the problem of protecting the personal rights of legal persons and consists of four chapters. It is intended to characterize the regime of protection of personal rights of legal entities based on the Civil Code, as well as non-Code regulations. The first chapter is devoted to introducing the key concepts from the point of view of this paper, which are the personal rights and the legal person. The issue of chapter two is the problem of the subject and object scope of the protection of the personal rights of legal persons. The first part of the chapter, characterizes the types of subjects whose personal rights are protected. The second part of the chapter is intended to consider the problem of the appropriate application of the regulations on the protection of personal rights of individuals to legal persons, and to characterize selected examples of the personal rights of legal persons. The third chapter is devoted to the characteristics of the claims available for the protection of personal rights, including claims available in the event of infringement of the right to a company. The fourth chapter is a compilation of regimes for the protection of the personal rights of legal persons outside the Civil Code. As part of the compilation, the protection measures available under the Act on Combating Unfair Competition, the Industrial Property Law, or the Code of Civil Procedure were analyzed
