Biolaw, Genetics and Human Rights. On Legal Scopes of European Biolaw and its Possible Application in the United States as a Source of a Fourth Generation of Human Rights

Abstract

Sobre el papel la Unión Europea recoge entre sus señas de identidad el respeto al pluralismo, a las minorías y a la diversidad cultural. Sin embargo, el futuro de la propia Unión en lo que respecta a ese paradigma culturalmente plural depende de decisiones políticas, tendencias jurídicas y hechos sociales. Este trabajo analiza algunas de las propuestas teóricas de construcción europea así como una selección de hechos sobre los que apoyar una respuesta al interrogante que sirve de título: ¿hay realmente un horizonte cultural en la UE?By considering the current lack of a binding legal framework to regulate the application of genetic techniques in the United States, biolaw's principles could be understood as deliberative elements to legislate on biomedical issues and act as procedimental criteria in American courts. This paper addresses that possibility by taking into consideration eventual scopes of genetic research and manipulation. Then, it is shown how biolaw's principles become guidelines to point out a fourth generation of human rights which should be considered as foundations to legislate on non-therapeutic genetic experimentation in the United State
