ZAKONODAVSTVO SJEDINJENIH AMERIČKIH DRŽAVA U VEZI TERORISTIČKIH DELA

Abstract

In this Article the author prepared one part of the legislation of the USA that is in the connection with terroristic criminal offences. In the frst part of the work are given views in connection with terrorism as general, and what works and articles are prepared in relation to Anglo-Saxon Criminal Law in domestic literature, especially in domestic articles, surveys and reviews with ascertain that are very few prepared works and articles. Then the author cites very few translated works from Anglo-Saxon Criminal Law and in relation to legal texts only one Criminal Code of Louisiana dated 1943 was translated. The second part of work represent translation of incriminations about terrorism from several Criminal Codes of Federal States of USA as follows; Arkansas, California, Delaware, Georgia, Hawaii, Iowa, Kansas, Maine, Michigan, Minnesota, New Hampshire, North Dakota, Pennsylvania, Tennessee, Texas and Utah. This is the frst translation and view of the legislation of USA in connection with criminal offence of terrorism in domestic legal literature. These codes were in force prior to September 11th, 2001 when happened terroristic act in New York City where were killed 5.000 persons. This date represent important date in fght against terrorism because terrorism became global problem world wide. It is the fact that former Criminal Codes of Federal States of USA were not severe in prescribing the penalty for terrorism as criminal offence. After September 11th, 2001 in USA were issued new Laws and other Acts against terrorism as criminal offence.U ovom radu, autorka daje osnovni prikaz zakonodavstva SAD u vezi sa terorističkim delima. U tom smislu, autorka daje prikaz odredaba krivičnog zakonodavstva većeg broja američkih država, kao na primer Arkanzas, Kalifornija, delaver, Džordžija, havaji, Ajova, Kanzas, itd. Autorka konstatuje da su zakoni u SAD sve do 11.septembra bili ne tako strogi, ali da taj datum, kada je u napadu na Njujork stradalo oko 5.000 ljudi, predstavlja prekretnicu i da zakonodavstvo u SAD po pitanju terorizma, od tada postaje znatno strožije
