In moslimlanden is het familierecht een delicaat onderwerp, onder meer vanwege de band met het religieuze recht, de sharia. Om die reden is familiewetgeving in de meeste moslimlanden sterk op de sharia geïnspireerd. In Tunesië is dit anders: de Tunesische familiewet van 1956 wijkt op belangrijke punten af van de sharia. In de Tunesische doctrine wordt echter betoogd dat rechters de sharia of gewoonterecht toepassen in plaats van of in aanvulling op de wet. Aan de andere kant stellen zij dat onder invloed van de toename van vrouwelijke rechters in de laatste jaren een parallelle rechtspraktijk is ontstaan. Deze is gender-neutraal en wordt gekenmerkt door de toepassing van grondwetsbeginselen zoals het gelijkheidsbeginsel. Maaike Voorhoeve onderzocht de rechtspraak op het gebied van het echtscheidingsrecht van een rechtbank in Tunesië, waar alle familierechters vrouw zijn. Dit deed ze aan de hand van vonnissen, interviews en observaties van zittingen. Voorhoeve concludeert dat de opvatting dat rechters de sharia zouden toepassen niet kan worden bewezen: als rechters al naar deze rechtsbron verwijzen, doen ze dat uitsluitend om de vaak onduidelijke wetstekst te interpreteren. Haar resultaten bevestigen evenmin de stelling dat rechters gewoonterecht zouden toepassen. Aan de andere kant vindt ze ook geen bevestiging voor het idee dat vrouwelijke familierechters grondwetsbeginselen toepassen. Toch is de beschreven rechtspraktijk op het gebied van echtscheiding wel gender-neutraal, althans voor zover het gaat om het recht op echtscheiding.
