Integrated Circuits: The Legal Protection of Topographies of Semiconductor Products.
The legal protection of topographies of semiconductor products (integrated circuits) was a
controversial issue in terms of framing in an adequate intellectual property right, considering that
unfair competition rules were not enough to satisfy the interests of creators and producers as well
as the interests of competitors and the general interest. The result was the establishment of a new
intellectual property right, a hybrid between copyright and patent laws firstly granted by the US
law maker and later by other countries, such as Japan. The European Community did also adopt a
directive harmonising basic principles of protection and the issues of reverse engineering and
second sourcing. This article, which has been originally written to support a communication to the
2nd Post-Graduate Course on Industrial Law organized by the Portuguese Association of Intellectual
Law, analyses the Portuguese legislation that implements the directive, searching for its conformity
with the community act, and has also into consideration the Washington Treaty as it results from
