La comunicación del gobierno español en situación de crisis: deberes y obligaciones para garantizar la transparencia y el derecho a la información veraz de la ciudadanía

Abstract

In times of crisis, governments must take extraordinary measures quickly and urgently. This fact may lead to the limitation of certain rights and freedoms of citizens and, for this reason, the communication of the executive power must be more rigorous, characterized by complying with a series of requirements that allow it to meet both the informational needs of society and the obligations required by the rules of transparency and the right to information. The situation caused by the Covid-19 pandemic has made it possible to verify the need that exists within these chaotic and uncertain scenarios, to guarantee transparency and the right of access to public information in order to protect citizens, avoiding the expansion of hoaxes and misinformation, especially in a political and social context where the collaboration of the population is required to manage the crisis. The research carried out goes deep into the obligations that the regulations on the right to information and transparency require from Government and Public Administration even in emergency situations, and into what has been their performance as sources of information and communication during the state of alarm. The goal of this analysis is to check whether Government has guaranteed the right to truthful information for Spaniards and whether it has behaved with respect for the principles of transparency during the management of the crisis.En momentos de crisis, los gobiernos deben tomar medidas extraordinarias de manera rápida y urgente. Este hecho puede conllevar la limitación de ciertos derechos y libertades de los ciudadanos y, por este motivo, la comunicación del Ejecutivo debe ser más rigurosa, caracterizándose por cumplir con una serie de requisitos que le permitan cumplir tanto con las necesidades informativas de la sociedad, como con las obligaciones que les exigen las normas de transparencia y Derecho de la Información. La situación provocada por la pandemia de la Covid-19 ha permitido comprobar la necesidad que existe dentro de estos escenarios caóticos y de incertidumbre de garantizar la transparencia y el derecho de acceso a la información pública con el fin de proteger a la ciudadanía, evitando la expansión de bulos y desinformaciones, especialmente en un contexto político y social donde se demanda la colaboración de la población para gestionar la crisis. En el estudio realizado se analizan las obligaciones que la normativa sobre derecho a la información y transparencia exige al Gobierno y a la Administración Pública incluso en situaciones de emergencia, y cuál ha sido su actuación como fuentes de información y comunicación durante el estado de alarma. El objetivo de este análisis es comprobar si el Gobierno ha garantizado el derecho a la información veraz de los españoles y si ha actuado respetando los principios de transparencia durante la gestión de la crisi
