Vinculación del sector empresarial en el marco institucional de erradicación y prevención del trabajo infantil en Colombia

Abstract

     The international organizations that are responsible in ensuring the protection of the rights of children, focus their efforts in the eradication of child labor, involving the main stakeholders who have a direct responsibility in the problem: state, business and society. Therefore the aim of this article is to identify the link between the business sectors in the institutional framework for eradicating child labor. Colombia has adopted an institutional framework through which aligns with international conventions that have been signed regarding the eradication of child labor. This document is the result of a documentary and descriptive research, the methodology used had two stages; the first one was a documentary review and the second one took the analysis of the contents. We can identify that the reviewed regulations are aligned with the willingness of the international agreements in Colombia; however, it is not linked directly with the business sector in the struggle and eradication of the child labor, except for the demand to stop hiring children and for the eradication of the worst forms of child labor. Even though, these two elements include the problem of the child labor, they don't give enough institutional tools to involve one of the most important players in this issue, as are companies.     Las organizaciones internacionales encargadas de velar por la protección de los derechos de los niños, concentran esfuerzos en la erradicación del trabajo infantil (TI), involucrando a los actores claves que tienen una responsabilidad directa en el problema: Estado, empresas y sociedad. Por tanto, el objetivo de este artículo es identificar la vinculación del sector empresarial en el marco institucional de erradicación del trabajo infantil. Colombia ha adoptado un marco institucional mediante el cual se alinea a los convenios internacionales que ha firmado al respecto en la erradicación del TI. Este documento es resultado de una investigación de tipo descriptivo con abordaje de revisión documental, esta metodología comprendió dos etapas: la primera fue la revisión documental y la segunda comprendió el análisis de contenido. Se identifica que las normas revisadas están alineadas con las disposiciones de los convenios internacional ratificados por Colombia; sin embargo, no se vincula de manera explícita al sector empresarial en la lucha y erradicación del TI, excepto por el llamado al cumplimiento de la no contratación de menores de edad y erradicación de las peores formas de trabajo infantil. Estos dos elementos que sí bien engloban el fenómeno del TI, no dan las suficientes herramientas institucionales que comprometan e involucren a uno de los actores más importantes en este flagelo, como lo son las empresas
