La salud y seguridad en el trabajo en la economía de plataformas

Abstract

With the advent of industry 4.0 and technological development, business based on the platform economy is increasingly common. With this type of economy, the optimization of resources is achieved, costs are saved, there is a greater offer for consumers and environmental protection is improved by sharing things. However, if we focus on the worker, the European Agency for Safety and Health at Work has highlighted the complexity that exists to quantify the number of digital platforms that exist and how many workers exist in them. Nor is it easy to determine what is the legal relationship between the worker and employer. All this legal uncertainty directly influences the prevention of occupational hazards. As the European Agency pointed out, some work characteristics of these platforms cannot be easily framed within the regulatory frameworks for the prevention of occupational risks that currently exist.Con la llegada de la industria 4.0 y el desarrollo tecnológico, los negocios basados en la economía de plataforma son cada vez más habituales. Con este tipo de economía se consigue la optimización de los recursos, se ahorran costes, existe una mayor oferta para los consumidores y se mejora la protección medioambiental al compartir las cosas. Sin embargo, si nos centramos en el trabajador, la Agencia Europea para la Seguridad y Salud en el Trabajo ha destacado la complejidad que existe para cuantificar el número de plataformas digitales que hay y cuántos trabajadores existen en ellas. Tampoco es fácil determinar cuál es la relación jurídica existente entre el trabajador y empresario. Toda esta incertidumbre jurídica influye de manera directa en la prevención de riesgos laborales.
