Abstract
Purpose ”“ This study aims at providing a definition of the essential content of the fundamental right to psychological integrity in the workplace from the perspective of moral harassment at work.
Methodology/approach/design ”“ To approach the topic, the point of departure lies on the historical transformation of the workplace and its impact on workers’ health. Psychological violence in the workplace materialized as moral harassment as part of current management strategies and its impact on workers’ mental health is analyzed through literature review and a study of the body of case law produced by the Brazilian Superior Labor Court.
Practical implications ”“ It is known that due to the current management models for labor and production, mental illness has been the third leading cause of rising absenteeism and leave from work. Based on the hermeneutics of fundamental rights and constitutional guarantees and the theory of institutional guarantees, this study weighs values/principles and fundamental rights in order to define the legal content of the fundamental right to psychological integrity in the workplace, as there is currently no specific protection against moral harassment as business management or organizational policies.

Metodologia/abordagem/design ”“ A abordagem do tema apoia-se na hermenêutica dos direitos e garantias fundamentais constitucionais e na teoria das garantias institucionais e parte das mudanças no mundo do trabalho e suas repercussões na saúde do trabalhador. A violência psicológica no ambiente laboral consubstanciada no assédio moral organizacional como estratégia de gerenciamento atual e suas repercussões na saúde psíquica dos assediados são analisadas por intermédio de revisão bibliográfica e de análise da jurisprudência do Tribunal Superior do Trabalho.
Resultados ”“ Verificou-se que, em razão dos atuais modelos de gerenciamento do trabalho humano e da produção, pesquisas demonstram que o adoecimento psíquico tem sido a terceira causa de afastamento do trabalho. Com base na hermenêutica dos direitos e garantias fundamentais constitucionais e na teoria das garantias institucionais, ponderaram-se valores/princípios e direitos fundamentais com vistas à delimitação do conteúdo jurídico do direito fundamental em estudo tendo em vista a ausência de tutela específica contra as práticas de assédio moral como política de gerenciamento empresarial ou institucional
