This essay explores the different dimensions of the relationship between
law and silence. It proposes four lines of research: (1) silence as
an object of regulation; (2) silence as a hermeneutical reference; (3) the
social effects of the silences of law, and (4) silence as constitutive of law.
The topic of silence as an object of regulation is divided, in turn, into
four categories: (a) compelled silence; (b) the right to silence; (c) legal
protection against silence; and (d) the attribution of legal consequences to
silence. The second line of research looks into the role of silence in legal
interpretation. More concretely: What is the legal meaning of not saying?
What normative consequences can or must interpreters draw from the
law´s silence? Thirdly, the essay examines some of the social effects of
silences in the law, such as the generation of invisibility, absences, marginalization,
exclusion and relations of subordination and domination.
Fourthly, the author proposes that silence is a constitutive element of
law, to the extent that law operates quietly to produce and reproduce
the world in which we live. The essay concludes with an exhortation to
convert silence into a category of legal analysis, so that it is routinely
incorporated into our teaching, research, publications and legal practice.El ensayo explora las diferentes dimensiones de la relación entre el
derecho y el fenómeno del silencio. Propone cuatro líneas de investigación:
(1) el silencio como objeto de regulación jurídica; (2) el silencio
como referente hermenéutico; (3) los efectos sociales de los silencios del
derecho y (4) el silencio como elemento constitutivo del derecho. El tema
del silencio como objeto de regulación jurídica se divide, a su vez, en
cuatro categorías: (a) el silencio obligado (o compelido); (b) el derecho
al silencio (o el silencio protegido); (c) la protección jurídica contra el
silencio y (d) la atribución de ciertas consecuencias jurídicas al silencio.
La segunda línea de investigación indaga sobre el lugar que ocupa el
silencio en el proceso de interpretación. Más concretamente: ¿qué significa
jurídicamente no decir?, ¿qué repercusiones normativas tiene o debe tener
el silencio del derecho a juicio del intérprete? En tercer lugar, se examinan
algunos de los efectos sociales de los silencios del derecho: tales como
la generación de invisibilidades, ausencias, marginaciones, exclusiones
y relaciones de subordinación y dominación. En cuarto lugar se plantea
que el silencio es un elemento inherente al derecho, pues este muchas
veces opera silenciosamente para producir y reproducir el mundo en que vivimos. El ensayo concluye exhortando a que se convierta el silencio
en categoría de análisis jurídico, de modo que se incorpore su examen
a la docencia, las investigaciones, las publicaciones y la práctica
jurídicas
