Constitutional basis of freedom of association in trade unions

Abstract

Freedom of association has its origins in an idea of civil society. The civil society with long and complex history becomes a fundamental element in a nowadays discourse on a well governed state. In such context an act of accession of Poland to European Union means integration with societies associating in various chains of associations, organisations, fundations, trade unions etc. – in the frame of what we used to call a civil society. Freedom of association is an essential element among other political rights and liberties. Trade unions, for example, are a form of association. Basically, they are associations of workers organised to protect the interests of their members in front of the employer. A trade union can represent the rights of employees more efficiently than an employee itself. The Constitution of the Republic of Poland of the 2nd April 1997 expresses freedom of association as a civil freedom. The Constitution emphesizes the particular role that trade unions play in accomplishing the rules of pluralism. The freedom of association in trade unions is guaranteed by article 59 of the Polish Constitution. The legislative system of the Third Republic of Poland secures favorable conditions for the development of pluralism and reinforces democratic law order and the idea of civil society.Wolność zrzeszania się stanowi niezwykle ważny element pośród praw i wolności politycznych. Jedną z form zrzeszania się są związki zawodowe, których istotą jest organizowanie się pracowników w celu obrony swoich interesów. Związek zawodowy może bowiem skuteczniej reprezentować interesy pracownika niż on sam. W Konstytucji Rzeczypospolitej Polskiej z 2 kwietnia 1997 r. (dalej: Konstytucja) zrzeszanie się zostało ujęte jako „wolność obywatelska”. Konstytucja podkreśla szczególną rolę związków zawodowych w realizacji zasady pluralizmu. W myśl art. 12 Konstytucji Rzeczpospolita Polska zapewnia wolność tworzenia i działania związków zawodowych. Wolność zrzeszania się w związki zawodowe jest też gwarantowana przez art. 59 Konstytucji. Respektowanie wolności zrzeszania się w związki zawodowe w systemie ustawodawstwa III Rzeczypospolitej Polskiej stwarza korzystne warunki dla rozwoju pluralizmu oraz przyczynia się do umocnienia demokratycznego porządku państwa i idei społeczeństwa obywatelskiego
