Formas de contratação em ambiente de inovação com modelo de hélice tríplice: um enfoque na lei do Sistema Único de Segurança Pública ? SUSP

Dissertação (mestrado) - Universidade Federal de Santa Catarina, Centro de Ciências da Educação, Programa de Pós-Graduação em Ciência da Informação, Florianópolis, 2021.As políticas públicas para a área de segurança devem ser discutidas e analisadas de modo que possam possibilitar a cooperação e integração entre os entes da Federação e os Órgãos da Segurança Pública. Desse modo, a iniciativa de criação do Sistema Único de Segurança Pública (SUSP) e a definição da Política Nacional de Segurança Pública representam tentativas de dar efetividade e eficácia à atuação do Estado na área. Os objetivos da pesquisa são de apresentar um Projeto de Contratação baseado na Hélice Tríplice e que seja adequado à Legislação sobre Inovação para ser utilizado no Sistema Nacional de Segurança Pública (SUSP), comparar a tradição jurídica atual de contratação com os novos padrões definidos pelo marco legal de CTI do País, analisar a viabilidade da interação da Hélice Tríplice e delimitar as responsabilidades na interação prevista. O método utilizado é a partir da pesquisa qualitativa, usando-se da leitura de textos bibliográficos para subsidiar a fundamentação de argumentos consistentes que viabilizem responder as questões levantadas no estudo. Com a utilização dos meios de pesquisa metodológicos, procura-se visualizar qual seria a modalidade de contratação indicada para desenvolver negócios no Ambiente de Inovação que utiliza o modelo de Hélice Tríplice, de acordo com a nova Lei do SUSP. Nos resultados, constata-se que ocorreu uma grande mudança na forma de gerenciar a Segurança Pública, sendo que, a nova legislação privilegia os acordos estabelecidos entre os entes parceiros, tendo a oportunidade de agregar valor nessa cooperação. Utiliza-se da Ciência da Informação para buscar-se, com a pesquisa, minorar as dificuldades em conseguir encontrar as respostas para as solicitações do mercado, principalmente por estar em análise a Inovação no modelo Hélice Tríplice entre as Empresas, as Universidades e o Estado. Também, são apresentados os Dados sobre a Comparação da Tradição Jurídica, Exemplos Relevantes identificados, Iniciativa de Encomenda Tecnológica e Proposta de Viabilização de um processo de compras com base na Lei de Inovação. Com a aplicação da legislação referente Ciência Tecnologia e Inovação na área de Segurança Pública abre-se espaço para a ampliação e melhoria da qualidade dos serviços prestados aos cidadãos, visto que, com a utilização dos procedimentos de Aliança Estratégica e de Encomenda Tecnológica poderão ser alcançados os resultados que são almejados. A contribuição deste trabalho para a comunidade científica e para os gestores da área de Segurança Pública torna-se visível diante da possibilidade de direcionamento das contratações destinadas à inovação poderem ser desencadeadas por meio da Encomenda Tecnológica que, anteriormente, não era estipulado no ordenamento jurídico. O interesse pelo tema possibilitou estudar as opções de contratações inovadoras possíveis na área de Segurança Pública e passíveis de trazer melhorias na forma de atuação das instituições e, possibilitando-se a sua ampliação por intermédio de outros trabalhos a serem desenvolvidos na área.Abstract: Public policies for the security area must be discussed and analyzed in such a way that they can enable cooperation and integration between the entities of the Federation and the Public Security Agencies. Thus, the initiative to create the Unified Public Security System (SUSP) and the definition of the National Public Security Policy represent attempts to give effectiveness and efficiency to the State's actions in the area. The objectives of the research are to present a Contracting Project based on the Triple Helix and that is adequate to the Legislation on Innovation to be used in the Unified Public Security System (SUSP), to compare the current legal tradition of contracting with the new standards defined by the legal framework of the Country's CTI, analyze the feasibility of the Triple Helix interaction and delimit the responsibilities in the foreseen interaction. The method used is based on qualitative research, using the reading of bibliographic texts to support the foundation of consistent arguments that make it possible to answer the questions raised in the study. With the use of methodological research means, we seek to visualize which type of contracting would be indicated to develop business in the Innovation Environment that uses the Triple Helix model, in accordance with the new SUSP Law. In the results, it appears that there was a great change in the way of managing Public Security, and the new legislation favors the agreements established between partner entities, having the opportunity to add value to this cooperation. Information Science is used to seek, with research, to alleviate the difficulties in finding answers to market requests, mainly because Innovation in the Triple Helix model between Companies, Universities and the State is being analyzed. It also presents Data on the Comparison of Legal Tradition, Relevant Examples identified, Technological Order Initiative and Proposal for the Feasibility of a procurement process based on the Innovation Law. With the application of the legislation regarding Science, Technology and Innovation in the area of Public Security, space is opened for the expansion and improvement of the quality of services provided to citizens, since, with the use of the Strategic Alliance and Technological Order procedures, they can be achieved the results that are desired. The contribution of this work to the scientific community and to managers in the Public Security area becomes visible in view of the possibility of directing the contracts for innovation that could be triggered by means of the Technological Order that, previously, was not stipulated in the legal system. The interest in the subject made it possible to study the possible innovative hiring options in the area of Public Security and likely to bring about improvements in the way institutions operate and, enabling its expansion through other works to be developed in the area
