Abstract

This research aims is to find out about the ban on the use of ex-rights to engage in an interprise without a license and the way of solving legal action through mediation resulted an agreement of partnership with a profit sharing between the two sides, that are between PTPN XII (Persero) and the farmers in the village Gondoruso . The method used in this research is normative juridical, with the specification analysis of descriptive research, the source of the data used is secondary data in the form of an agreement between the two sides, the Law and the literature books related to the research problem. Data are presented systematically and qualitative data analysis. Based on the research conducted on these facts is the lack of knowledge for society about the regulations on the procedure for dominating land as well as an understanding of soil displaced since sides related to the registration and procedure of land ownership is also seen to lack of socialization, it can be seen that there are inequalities or missing communication about land domination. This case leads to legal action continuation as well as delay in the extension of the right to engage in an interprise proposed by PTPN XII (Persero) for the problems and demos of local inhabitants to demand to those who competents to record and recheck the rights to engage land to be extended by PTPN XII (Persero) , Thus citizen action is not without reason, because during the right to engage in interprise is still attached to the PTPN XII (Persero), the farmers who cultivate the land is the agriculture doer who made the cultivated land so that there is no chunk land and in a accordance with the use of land before
