Em recente artigo, o ministro do STF Luís Roberto Barroso defendeu o exercício de um papel representativo pelo Poder Judiciário (mais precisamente pelos tribunais constitucionais), como forma de dar voz a uma vontade da maioria não captada pelas regras de direito positivo devido às distorções dos mecanismos institucionais fundados no voto (eleições e processo legislativo). O presente trabalho tem como objetivo investigar se essa reivindicação é compatível com a noção de Estado Democrático de Direito levando em consideração tanto a possibilidade de se aferir a vontade empírica da maioria à parte dos mecanismos institucionais fundados no voto quanto a função do Judiciário nesse tipo de sociedade. Por fim, sugere a possibilidade de reconhecer um papel representativo ao Judiciário fundado naquilo que se pode argumentar ser o interesse dos cidadãos de um Estado Democrático de Direito enquanto tais.In a recent paper, Brazil’s Supreme Court Justice Luís Roberto Barroso sustained the exercise of a representative role by the judicial branch (more precisely by constitutional courts), as a way to give voice to the will of the majority when it is not captured by positive legal rules due to the distortions of the institutional mechanisms based on voting (elections and legislative process). This paper aims to investigate whether this claim is compatible with the notion of a Democratic State under the rule of law, taking into consideration both the possibility of gauging the empirical will of the majority apart from the institutional mechanisms based on voting and the role of the judicial branch in this kind of society. Finally, it suggests the possibility of acknowledging a representative role to the judiciary based on what can be argued to be the interest of the citizens of a constitutional democracy as such
