Informe sobre la Casación Nº 1588-2017-CALLAO

Abstract

El presente informe realiza un análisis respecto a la Casación Nº 1588-2017-CALLAO emitida por la Sala Civil Permanente de la Corte Suprema de Justicia de Lima, la cual resuelve un recurso de casación interpuesto por la infracción del artículo I del Título Preliminar del Código Procesal Civil en el marco de una demanda de accesión. A través del presente informe, se analiza lo resuelto en primera y segunda instancia; y en casación para poder identificar problemas jurídicos y brindar una respuesta a los mismos. El análisis se centra en el alcance del concepto de legitimidad para obrar, la vinculación de legitimidad para obrar con el derecho a la tutela jurisdiccional efectiva y la aplicación del artículo 396º del Código Procesal Civil.This report analyses Cassation 1588-2017-CALLAO issued by the Permanent Civil Court of the Supreme Court of Justice of Lima, which resolves a cassation appeal filed for the infringement of Article I of the Preliminary Title of the Civil Procedure Code in the context of a claim for accession (demanda de accesión). This report analyses the issues resolved at first and second instance and in cassation in order to identify the legal problems and respond to them. The analysis focuses on the scope of the concept of legitimacy to act, its relationship the right to effective judicial protection and the application of Article 396 of the Civil Procedure Code
