Tämän opinnäytetyön tavoitteena on perehtyä kattavasti oleskelulupiin Suomessa. Työssä käsitellään aiheeseen liittyviä käsitteitä ja käydään läpi oleskelulupaprosessia kokonaisuudessaan aina oleskeluluvan yleisistä edellytyksistä maasta poistamiseen ja valitusmenettelyyn.
Ulkomaalaislaissa säädetään yleiset edellytyksen oleskeluluvan myöntämiselle. Oleskelulupatyyppejä on kolmenlaisia, se voi olla jatkuva, tilapäinen tai pysyvä. Lisäksi käytössä on oleskeluoikeuden rekisteröinti EU-valtioiden ja siihen rinnastettavien valtioiden kansalaisille.
Oleskelulupa voi päättyä tai se voidaan menettää ja sitä seuraa yleensä maasta poistaminen. Opinnäytetyössä käsitellään myös näihin liittyviä perusteita ja säännöksiä. Oleskelulupa-asioissa on yleensä myös muutoksenhakuoikeus, kuten muissakin viranomaispäätöksissä.
Näitä kaikkia osa-alueita on tarkasteltu sekä yleisen oleskelulupamenettelyn, että kansainvälisen suojelun osalta. Osa-alueet on eroteltava toisistaan siksi, että sääntely poikkeaa näiden kahden välillä merkittävästi.The aim of this thesis is to give a guide residence permits in Finland. The thesis deals with concepts of immigration and the process of residence permits. The thesis covers the whole process from the general provisions about residence permits to removing illegal citizens from country. Appeal procedure are also included and discussed.
General provisions to admit residence permit are regulated by the Aliens Act. There are three types of residence permits; it can be continuous, temporary or permanent. The citizens of an EU member state and comparable persons do not need a residence permit, they can register their right of residence without it.
Residence permit can run out or it can be taken away and usually as a consequence of that is the removing of the person from the country. The thesis deals with the basics and the provisions of removing. There is also appeal procedure in residence permits like other authoritative decisions.
All of these sections are analyzed from the perspective of both general procedure of residence permits and international protection. As the regulations vary between these perspectives, sections have to be separated
