Ulkomaalaislupa-asioiden toimivallan siirtoa poliisilta Maahanmuuttovirastolle on suunniteltu jo vuosia. Siirto tuli voimaan 1.1.2017, jonka jälkeen Maahanmuuttovirasto vastaa kaikista ulkomaalaislupa-asioista. Ennen siirtoa poliisin vastuulla oli muun muassa jatko- ja pysyvät oleskeluluvat, EU-kansalaisen oleskeluoikeuden rekisteröinnit, osa pakolaisen matkustusasiakirjoista ja muuka-laispasseista sekä vireillepanoon ja tiedoksiantoon liittyvät tehtävät.
Opinnäytetyön tarkoituksena on selvittää, miksi toimivallan siirto tehtiin ja miten se käytännössä vaikuttaa oleskelulupaprosessiin. Työssä on käytetty laadullista tutkimusmenetelmää. Tutkimus on toteutettu kahdella teemahaastattelulla. Toinen haastateltavista siirtyi poliisilta Maahanmuutto-virastoon ja toinen on työskennellyt Maahanmuuttovirastossa aiemminkin.
Toimivallan siirrolla tavoitellaan prosessien tehostamista ja yhtenäistämistä. Poliisilaitosten välillä on aiemmin ollut erilaisia käytäntöjä ulkomaalaislupa-asioissa, koska yhtenäistä ohjeistusta toimintatapoihin ja laintulkintaan ei ole nykyiseen tapaan ollut. Asioiden siirtely viranomaisten välillä on loppunut, joka tehostaa ja nopeuttaa prosesseja. Siirron jälkeen poliisi voi keskittyä paremmin ydintehtäviinsä ja Maahanmuuttovirasto pystyy kehittämään tehokkaammin menettelyä ulkomaalaislupa-asioissa.
Maahanmuuttovirasto on toimipisteverkosto on siirron myötä kasvanut huomattavasti, koska sillä ei ole aiemmin ollut alueellisia asiakaspalvelupisteitä. Palvelupisteitä on nyt yhdeksän, kun taas poliisilla ulkomaalaislupa-asioita käsitelleitä poliisiasemia oli noin 70. Asiointimatkat ovat siis joissain tapauksissa pidentyneet, jota jatkossa pyritään helpottamaan sähköisen asioinnin lisäämisellä.
Siirron jälkeen yksinkertaisimmat oleskelulupahakemukset ratkaistaan Maahanmuuttoviraston palvelupisteistä ja monimutkaisemmat lähetetään toimipisteisiin, joissa ne ratkaistaan keskitetysti. Toimintatavat eivät ole vielä vakiintuneet ja uutta ohjeistusta tuotetaan koko ajan lisää. Hakemusten käsittelyaikoja ei voida vielä arvioida tarkasti, koska poliisilta siirtyi tuhansia ratkaisemattomia hakemuksia, joita ei vielä olla ratkaistu. Haastatteluiden perusteella siirto on sujunut hyvin pieniä käytännön ongelmia lukuun ottamatta. Siirto jouduttiin lopulta tekemään melko nopealla aikataululla, sillä lainmuutokset hyväksyttiin eduskunnassa vasta puoli vuotta ennen siirron voimaantuloa.The transfer of the jurisdiction over permits for foreigners was planned for years. In practice this means that the jurisdiction is transferred from the police to the Immigration office. The transfer was implemented on 1st January 2017 and after that the Immigration office has handled all the permits of foreigners. Before the transfer the police handled for example the extended and permanent residence permits.
The goal of this thesis was to study why this transfer was made and how it affects the residence permit process in practice. This thesis has used qualitative research method. Research has been carried out by conducting two theme interviews. The first interviewee was transferred from the police to the Immigration office and the second interviewee had already worked there before the transfer was implemented.
The idea behind the transfer is to rationalize and harmonize the processes. There have been some procedural differences between the police stations in handling permits for foreigners. The reason for the differences is that there has not been as much coherent guidance in the interpretation of law as there is today. There is no longer any need to move the applications between authorities which speeds up the processes. After the transfer, the police can focus more on their main tasks, and Immigration office can develop more efficient procedure.
The Immigration office has expanded the network of offices significantly because it did not have regional customer service before. There are now nine customer service offices. Before the transfer, the police had about 70 offices processing permits for foreigners. The distances to the offices have increased for some customers. In the future, the Immigration office will attempt to compensate that with increase of electronic services.
After the transfer simple residence permit applications are processed in local offices. The more complex applications are sent to offices to be processed centralized. The operations have not become established yet and new guidance is being offered constantly. It is not possible to estimate the processing times precisely because thousands of unfinished residence permit applications were moved from the police to the Immigration office. Some of these applications are still in the process. Based on the interviews the transfer was a success apart from a few minor problems. The transfer was implemented fast because the law was accepted in the parliament only six months before the transfer
