source:1  Australian Property Law and Practice Committee Queensland Property Law Developments  A number of recent legislative amendments impact on property law practice in Queensland. Property Law (Mortgagor Protection) Amendment Act 2008 (Qld) The Property Law (Mortgagor Protection) Amendment Act 2008 (Qld) amended s 85 of the Property  Law Act 1974  (Qld) which obliges  a mortgagee exercising power of  sale  to  take reasonable  care  to  ensure  the  property  is  sold  at  market  value.    Following  these amendments,  the  operation  of  s  85  has  been  both  extended  and  strengthened.    The amendments commenced by proclamation on 12 December 2008. The  objective  of  the  amending  legislation was  to  protect  the  interests  of mortgagors  by strengthening  the  statutory  provisions  relating  to  the  duty  of  the  mortgagee  exercising power of sale to take reasonable care to ensure the property  is sold at market value.   The effect of  the amendments  to s 85  is  to extend  the duty  imposed under s 85  to situations where property is sold by a receiver under a delegated power or by the mortgagee acting as attorney  for  the  mortgagor.    By  way  of  strengthening,  to  satisfy  the  obligation  to  take reasonable care to ensure the property is sold at market value, s 85(1A) specifies the steps which must be taken by a mortgagee or a receiver for a ‘prescribed mortgage’. Under  the  terms of  the Property  Law Regulation  2003  (Qld),  for  the purposes of  s  85,  a mortgage  is  a  prescribed  mortgage  if  it  is  a  mortgage  over  residential  land  and  the mortgagor’s home  is on the  land.   The regulation  further provides that  it does not matter that a residence is also used for a business purpose if the residence is primarily used as the mortgagor’s home. In  relation  to  a prescribed mortgage,  the  steps  that must be  taken by  a mortgagee or  a receiver, unless the mortgagee or receiver has a reasonable excuse, are:  Adequately advertise the sale;   Obtain reliable evidence of the property’s value;  Maintain the property, including by undertaking any reasonable repairs;  Sell the property by auction, unless it is appropriate to sell it in another way; and  Do anything else prescribed under a regulation. Failure  to  follow  the  steps  specified  in  relation  to  a  ‘prescribed mortgage’  constitutes  an offence with the maximum penalty being 200 penalty units (presently $20,000).    2  Body Corporate and Community Management Amendment Act 2009 (Qld) In Bossichix Pty Ltd v Martinek Holdings Pty Ltd  [2009] QCA 154, the Queensland Court of Appeal  dismissed  an  appeal  where  at  first  instance  a  buyer  was  held  to  have  validly terminated  a  contract  due  to  a  technical  breach  of  s212  of  the  Body  Corporate  and Community  Management  Act  1997  (Qld).    The  breach  was  a  result  of  the  contract  not complying strictly with prescribed statutory wording in that the buyer was not given proper notice that the relevant community titles scheme had been established. Following  this  decision,  the  Queensland  government  announced  that  there  would  be legislative amendment of  s 212.    In particular,  the government was  concerned about  the prospect  of  buyers  avoiding  contracts  on  purely  technical  grounds without  any material detriment being suffered.  The government was also concerned about uncertainty for sellers and developers particularly in the context of long term off‐the‐plan sale contracts. As a result, the Body Corporate and Community Management Act 2009 (Qld) commenced on 22 June 2009.   New s 212 applies to a contract for the sale of a  lot  intended to come  into existence as a lot included in a community titles scheme when the scheme is established or changed.   The contract  is taken to  include a deemed term to the effect, despite any other provision,  that  settlement must not  take place earlier  than 14 days  after  the  seller  gives advice to the buyer that the scheme has been established or changed.   The deemed term has priority over any other term of the contract relating to settlement and any notice the seller gives to the buyer is void to the extent it is inconsistent with the deemed term. Limited  rights of  cancellation are now provided under new  s 212A.   Under  this provision (which replaces the previous s 212(3)), a buyer may only cancel the contract if there was no proposed  community management  statement  for  the  scheme  as  established  or  changed when the contract was entered into and if the contract has not already been settled. Residential Tenancies and Rooming Accommodation Act 2008 (Qld) From 1  July 2009,  the Residential Tenancies and Rooming Accommodation Act 2008  (Qld) replaced  the  Residential  Tenancies  Act  1994  (Qld)  and  the  Residential  Services (Accommodation) Act 2002 (Qld). The new legislation includes a number of significant provisions:  Section 57(1) provides that a residential tenancy for premises is not to be advertised or otherwise offered unless a fixed amount  is stated as the amount of rent for the premises.  Section 91(4) provides that a residential tenant must be given 2 months notice of a rent increase. 3   Section 93(2) provides that existing rent under a residential tenancy agreement must not be increased less than 6 months since the date the existing rent became payable by the tenant.  The sale of rental properties is regulated by new statutory provisions. Sustainable Planning Act 2009 (Qld) This Act  received assent on 22 September 2009.   The Act will commence on a date  to be fixed by proclamation.  Once operative, the Act will repeal the Integrated Planning Act 1997 (Qld).    Although  preserving  the  Integrated Development  Assessment  System  (IDAS)  used under the Integrated Planning Act 1997 (Qld) and sharing other similarities, this Act seeks to address a number of deficiencies associated with the current legislation. As  noted  in  the  explanatory  notes  that  accompanied  the  introduction  of  the  legislation, outcomes to be achieved by the legislation: “Are a  significantly  improved and  streamlined  land use planning and development framework  and  systems  that  reduce  costs  and  get  development  on  the  ground sooner through:  streamlining – at plan‐making and development assessment levels leading to   simpler,  clearer and better  integrated planning  that produces more  certain   development assessment.  This results in greater certainty, faster processing,   and  reduced  costs  for  both  applicants  and  the  local  government.    Broad   economic  benefits  are  realised  including  the  State's  commitment  to  the   Housing Affordability Strategy.  clarity  –  in plan‐making  that  "front  loads" plans with  consistent provisions   and structure, and clearer and better  integrated State  interests  in planning.    This  certainty  and  integration  enables  faster  development  assessment  and   cost benefits.  greater  flexibility  and  responsiveness  –  the  streamlined  systems  including   the movement of processes out of  a  regulatory  framework  gives  the  State   greater  flexibility  to  adjust  the  framework  and  its  State  level  planning   interests to meet emerging needs of the State and other stakeholders  Plan making is improved by:  enhancing  mechanisms  to  achieve  State  level  planning  outcomes  such  as   accelerated  and  clearer  State  planning  policy  development  processes  and   enhanced Ministerial powers to  intervene  in the planning and development   process,  such  as  directly  amending  local  planning  instruments  where  an   urgent issues arises;  clarifying  and  confirming  the  precedence  and  relationship  between  State   planning instruments;  introducing  limited  prohibition  to  apply  in  prescribed  circumstances   enhancing the certainty of development outcomes;  making  the  infrastructure  charging  regime  even  more  transparent  and   equitable including through more flexible plan development process; and 4   streamlining the plan‐making process for local government including through   the  introduction  of  standard  planning  scheme  provisions.    Moving   components of the plan making processes from the legislation to subordinate   legislation and  statutory  instruments offers  the State greater  flexibility and   responsiveness to emerging issues in plan making. Development  assessment  processes  are  enhanced  by  the  clarity  and  certainty achieved by  improved plan making through a potential reduction  in the number of applications  entering  the  system;  more  applications  progressing  through  simpler processes  (such  as  the  new  compliance  assessment  track);  greater  certainty  in making  applications;  and  more  reliable  and  compliant  applications  being  made.  Time  and  cost  benefits  with  flow‐on  economic  effects  result  in  faster  better integrated development on ground.  This is achieved through:  streamlining  and  simplifying  development  assessment  processes  such  as   shortened  timeframes  for  taking  certain  actions,  including  times  for   responding  to  requests  for  information,  greater  flexibility  regarding  lapsed   applications,  changes  to  provide  for  electronic  application  and  assessment   processes,  deemed  approval  for  certain  code  assessable  applications,  and   measures to improve the quality of applications; and  enhancing  access  to  more  options  for  dispute  resolution,  for  example,  by   expanding the jurisdiction of what was previously known as the Building and   Development  Tribunals  (now  called  the  Building  and Development Dispute   Resolution Committee) and giving the courts powers in the case of vexatious   appeals.”1 Vegetation Management and Other Legislation Amendment Bill 2009 (Qld) This Bill was  introduced  into the Queensland  legislative assembly on 6 October 2009.   The Bill will amend the Vegetation Management Act 1999 (Qld) and the Integrated Planning Act 1997  (Qld)  to  provide  a  new  legislative  framework  to  regulate  the  clearing  of  certain Queensland regrowth vegetation.  The Bill is expected to impact on approximately 1 million hectares  of Queensland  vegetation.    In  the  absence  of  an  exemption  or  a  development permit, it will be an offence to clear regulated regrowth vegetation.  The Bill will also make amendments to the Land Act 1994 (Qld) and the Land Title Act 1994 (Qld) which will extend the present stay on the registration of survey plans for tidal boundaries. Property Agents and Motor Dealers Act 2000 (Qld) As advised by the Queensland Minister for Tourism and Fair Trading, Hon Peter Lawlor MP, in a letter to the President of the Queensland Law Society on 18 September, the Queensland government  is  preparing  amendments  to  Chapter  11  of  the  Property  Agents  and  Motor Dealers Act 2000 (Qld) with a view to simplifying the presentation and delivery of contracts for  residential  real  estate  and  the  warning  statement.    On  present  indications,  this amending  legislation may  be  expected  to  be  introduced  into  the Queensland
