Las medidas cautelares son las encargadas de garantizar el resultado de un proceso, proteger el objeto y evitar el incumplimiento de la sentencia, se analizó si los animales domésticos pueden ser objeto de ellas. Se relacionaron los pronunciamientos que ha venido realizando la Corte Constitucional acerca de este tema, generalmente se refiere a la protección de los animales en contra del maltrato y explotación que este ha venido sufriendo a través de los años, centrados en la búsqueda de información y antecedentes que hagan referencia al tema, por ello, se considera que es una investigación socio jurídica, en el cual se aplica una investigación descriptiva con un enfoque cuantitativo y como fuentes primarias la ley y jurisprudencia, secundarias doctrina. Concluyendo que, técnicamente los animales domésticos en Colombia pueden ser objeto de una medida cautelar, pero esta se podría poner a disposición de un juez con el fin que brinde protección al animal y su familia y si esta genera trastornos afectivos relacionados con la antrozoología, derivados de la privación de la relación entre el tenedor del animal domestico y la mascota.Universidad Libre- Facultad de Derecho- Especializacion en Derecho ProcesalThe precautionary measures are in charge of guaranteeing the result of a process, protecting the object and avoiding non-compliance with the sentence, it was analyzed whether domestic animals can be subject to them.
