Rad na daljinu

Abstract

Rad analizira institut rada na daljinu, počevši od radnih odnosa i ugovora o radu kao temeljnog okvir unutar kojeg se razvio rad na daljinu. U nastavku se obrađuje nastanak rada na daljinu, različiti pojmovi kojima se diversificira te oblici u kojima se manifestira, kao i njegova europska i međunarodna pravna regulativa. Nadalje slijedi pitanje kako je rad na daljinu uređen u RH, a kako komparativno u pravnom sustavu SAD-a, na koje se nadovezuje sudska praksa u RH i EU. U završnom dijelu analiziraju se prednosti i opasnosti takvog oblika rada te uspjeh odnosno brojna otvorena pitanja koja je isti polučio u pandemiji COVID-19. Konačno, kakvi su društveni utjecaji rada na daljinu te koje sve mogućnosti pružaju moderne tehnologije u daljnjoj regulaciji, odnosno optimizaciji i unapređenju rada na daljinu.The thesis analyses remote working, starting with employment and employment contract as a fundamental framework that enabled the development of remote work. Hereafter the thesis elaborates the origins of remote work, various terms, deffinitions and conceptualizations that can be comprised under the idea of remote work, as well as the international and European regulatory framework. Next, the regulation of remote work in Croatia, compared with its counterpart in the USA, followed by Croatian and European case laws. In the later part, pros and cons of remote work are being analyzed, alongside with the success as well as a number of challenges that it has come acros during the outbreak of the COVID-19 pandemic. Finally, what are the social impacts of remote work and what are the possibilites that modern technologies render in terms of future regulation, optimisation and enhancement of remote work
