Study on the Merchandising Right of People

Abstract

随着市场经济的进一步发展,意识形态的变化也日新月异,社会上真实人物形象被用于商业开发的现象日益突出,大量纠纷不断涌现。由于现有理论和相关法律规定的欠缺,司法机关在处理该类难题时显得有些束手无策。基于此,笔者认为,对真实人物形象商品化权制度进行研究具有较高的理论和实践意义。真实人物形象商品化权是指将能够产生商业信誉的真实人物的姓名、肖像、声音、动作等人格特征形象因素进行商业性使用的权利。该权利是属于知识产权中的一项新型权利。现存的保护主要为人格权保护和反不正当竞争保护。但这些保护力度无法满足现状,因此急需进行完善。本文除引言和结束语外,共分四章。文章第一章就真实人物形象商品化权的定义和来源阐述了...With the development of of the market economy in China, the social ideology changes very fast.
