Abstract

В статье исследуется суть проблемных аспектов прекращения уголовного производства на стадии досудебного расследования на основании п. 3 ч. 1 ст. 284 («не установлены достаточные доказательства для доказывания виновности лица в суде и исчерпаны возможности их получить») УПК Украины. В частности автор обращает внимание на неудачную формулировку названия исследуемого основания прекращения уголовного производства, проблему соотношения понятия «непричастность лица к совершению уголовного правонарушения» с такими реабилитирующими основаниями прекращения уголовного производства, как отсутствие в деянии состава преступления и неустановление достаточных доказательств для доказывания виновности лица в суде и исчерпание возможности их получить, а также проблему уведомления законного представителя подозреваемого, законного представителя потерпевшего, гражданского истца, гражданского ответчика, их представителей и законных представителей гражданского истца об окончании досудебного следствия прекращением уголовного производства. Автор также предлагает внести в УПК Украины определенные изменения с целью преодоления вышеперечисленных проблем для защиты прав участников уголовного производства. (The article discusses the essence of the problematic aspects of the criminal proceedings termination at the stage of pre-trial investigation on the basis of paragraph 3 part 1 article 284 («not established sufficient evidence to prove the guilt of a person in court and the exhausted possibilities of their obtainment») the Code of Criminal Procedure of Ukraine. In particular, the author draws attention to the unfortunate wording of the title of the studied grounds for termination of criminal proceedings, the problem of the relation between the concept of «innocence of a person in committing a criminal offense» and such rehabilitative grounds for criminal proceedings termination, as the absence of corpus delicti and the failure to establish sufficient evidence to prove the guilt of a person in court and the exhaustion of the possibilities to obtain them, as well as the problem of the notice of the legal representative of the suspect, the legal representative of the victim, civil plaintiff, civil defendant, their representatives and legal representatives of the civil plaintiff regarding the ending of the pre-trial investigation by the termination of criminal proceedings. The author also proposes to introduce to the Code of Criminal Procedure of Ukraine certain changes in order to solve the above problems to protect the rights of participants of criminal proceedings/
