Abstract
زمینه و هدف: نقش آموزههای اخلاقی در ساحت حقوق کیفری، سهم حقوق کیفری در حمایت از فضای سایبری و در نهایت تأثیر فضای سایبری بر جهانیشدن حقوق کیفری، باعث شکلگیری نظم جهانی فضای سایبر گردیدهاند. بررسی تأثیر آموزههای اخلاقی بر نظام فوقالاشاره با تکیه بر جرمانگاریهای صورتگرفته در کنوانسیون جرائم سایبری اروپا (بوداپست)، هدف پژوهش پیش روی است.
مواد و روشها: نوع پژوهش حاضر و روش به کار گرفتهشده در آن، توصیفی ـ تحلیلی میباشد.
ملاحظات اخلاقی: در پژوهش پیش روی، حفظ اصالت متون و امانتداری در نقل گفتار، به عنوان مهمترین بایستههای اخلاقی، مورد نظر نویسندگان بوده است.
یافتهها: آموزهها و مؤلفههای اخلاقی، تأثیر قابل توجهی بر شکلگیری نظم جهانی فضای سایبر به طور عام و جرمانگاریهای صورتگرفته در کنوانسیون بوداپست به طور خاص داشتهاند که با توجه به هنجارمندی ذاتی حقوق کیفری، منطقی به نظر میرسد.
نتیجهگیری: مهمترین جلوههای تأثیرپذیری از آموزههای اخلاقی در کنوانسیون بوداپست را میتوان در جرمانگاری هرزهنگاری کودکان و همچنین حمایت از حریم خصوصی و شخصیت معنوی اشخاص، ملاحظه نمود.Background and Aim: The role of ethical teachings in the field of criminal law, the role of criminal law in supporting cyberspace and finally the impact of cyberspace on the globalization of criminal law, have led to the formation of a global order of cyberspace. The aim of the present study is based on the criminalizations made in the European Convention on Cybercrime (Budapest).
Materials and Methods: The type of research and the method used in it is descriptive-analytical.
Ethical Considerations: In the present study, preserving the originality of texts and fidelity in quoting speech, as the most important ethical requirements, have been considered by the authors.
Findings: Moral teachings and components have had a significant impact on the formation of the global order of cyberspace in general and the criminalizations made in the Budapest Convention in particular, which seems reasonable given the inherent normality of criminal law.
Conclusion: The most important manifestations of the influence of moral teachings in the Budapest Convention can be seen in the criminalization of child pornography as well as the protection of privacy and the spiritual personality of individuals.
