Abstract: In this paper, it is analysed whether, under the Portuguese legal system, it is possible for a person to have simultaneously the status of director and worker in the same company, concluded by the negative answer. Furthermore, this solution, enshrined in the law for public companies, should also apply to private companies.No presente artigo analisa-se se, no ordenamento jurídico português, é possível uma pessoa ter a qualidade de administrador e simultaneamente de trabalhador de uma mesma sociedade, concluindo-se pela resposta negativa. Conclui-se ainda que esta solução, prevista na lei para as sociedades anónimas, deve igualmente valer para as sociedades por quotas
