JUDGE BUTLERAssignment for Benefit of Creditors:Effect of Federal Bankruptcy Act onAttempted Discharge of Assignorfrom Liability.Our general assignment act of 1897(Comp. Laws, Sec. 6241 et seq.) hastwo distinct features:(1) It provides for administeringthe estate of the assignor for the bene-fit of creditors. This provision of theact is not ipso facto suspended andsuperseded by the Federal Bankruptcyact. The making of such an assign-ment, however, is an act of bankrupt-cy; and if the assignor is adjudged abankrupt, in proceedings brought with-in the statutory time, the state courtis thereby deprived of further juris-diction over the assigned estate.(2) It provides for the assignor'sdischarge from liability. White, No. 93423.DIVISION IV.JUDGE STARKWEATHERSummons-Issuance by Attorney-Validity:Where, on motion to vacate judg-ment for attorney's fee and costs ren-dered for defendant on motion to dis-miss action for failure to file com-plaint within ten days under Sec. 34,Code 1921, it appeared that plaintiff'sattorney had not been admitted topractice law in the State of Coloradoand had purported to issue and sign asummons and caused the same to beserved upon the defendant and nocomplaint having been filed by theplaintiff.Held; Under authority of Bennie v.Triangle Ranch Co., 73 Colo. 586, thatdefendant's judgment was void; thatno action was ever commenced by theplaintiff and therefore defendant couldnot dismiss an action which had neverbeen instituted and predicate a validjudgment for attorney's fees and coststhereon.Hcld further; That plaintiff was notestopped to show ,that his supposed at-torney was without authority of lawsince the defect was jurisdictional, thecourt never having acquired jurisdic-tion over the plaintiff or the subjectmatter.Ronaldson v.
