Currently, in the trend of international economic integration, when business and commercial disputes are more and more complicated, the application of precedent to resolve those disputes is considered one of the solutions. effective. However, reality shows that in the process of settling disputes, there are still many shortcomings in the issuance, publication and use of precedent, leading to low effectiveness of precedent application. The article focuses on analyzing a number of issues that are still limited in the process of case law application from which to propose solutions to improve the efficiency of precedent application to resolve disputes in business and trade in Vietnam.Hiện nay, trong xu thế hội nhập kinh tế quốc tế, khi mà các tranh chấp kinh doanh, thương mại ngày càng nhiều và phức tạp, việc áp dụng án lệ để giải quyết các tranh chấp đó được xem là một trong các giải pháp hữu hiệu. Tuy nhiên, thực tiễn cho thấy trong quá trình giải quyết các tranh chấp, còn nhiều bất cập trong việc ban hành, công bố và sử dụng án lệ dẫn đến hiệu quả áp dụng án lệ còn thấp. Bài viết tập trung phân tích một số vấn đề còn hạn chế trong quá trình áp dụng án lệ từ đó đề xuất giải pháp nhằm nâng cao hiệu quả áp dụng án lệ để giải quyết các tranh chấp trong kinh doanh, thương mại Việt Nam hiện nay
