Elementos de evaluación en la implementación del sistema de responsabilidad penal para adolescentes desde el paradigma del neoinstitucionalismo: estudio de caso para el Municipio de Palmira

Abstract

The modernization of the State and the transfer of policies appear as a phenomena that have transcended to the administration of Justice in the national system. This document seeks to provide elements that contribute to the evaluation of the System of Penalty Responsibility for Adolescents (SRPA) in the municipality of Palmira. Proposed variables are based on the recognition of the actors involved in the process, specifically three interviews with a prosecutor specialized in juvenile, a lawyer who is part of the Judicial Services for Juvenile Offender Centre (CESPA). The perspective from which the evaluation is based is the new institutionalism; in its first part the article offers a reflection on the integration between its sociological, economical and politological sides. The second paragraph defines the problem presenting some statistics of violence and criminality, highlighting the participation of minors in these realities and defined risk situations that skirt the issue. Finally the structural flaw in the prevention of youth violence it´s revealing, presenting a diagram that summarizes the variables to assess the implementation of the SRPA. It is expected to transform the variables into indicators and validate the schema in order to offers elements for the improvement of the application of the system, as a contribution in decision-making in of youth policy´s fieldLa modernización del Estado y la transferencia de políticas aparecen como fenómenos que han trascendido a la administración de justicia en el sistema nacional. El presente documento busca ofrecer elementos de análisis que aporten a la evaluación del Sistema de Responsabilidad Penal para Adolescentes (SRPA) en el Municipio de Palmira. Las variables propuestas parten del reconocimiento de los actores involucrados en el proceso, específicamente de tres entrevistas realizadas con un fiscal especializado en menores, un abogado que forma parte del Centro de Servicios Judiciales para Adolescentes (CESPA) y un menor infractor. La perspectiva desde la que se fundamenta la evaluación es el neoinstitucionalismo; en su primera parte el artículo ofrece una reflexión sobre la integración entre sus vertientes sociológica, económica y politológica. En su segundo apartado se define la problemática presentando algunas estadísticas sobre violencia y criminalidad resaltando la participación de los menores en estas realidades y se señalan algunas situaciones de riesgo que develan la falla estructural en materia de prevención de la violencia juvenil. Finalmente se presenta un esquema que sintetiza las variables para evaluar la implementación del SRPA. Se espera transformar las variables en indicadores y validar el esquema de manera que ofrezca elementos para el mejoramiento de la aplicación del Sistema y aporte sustantivamente en la toma de decisiones en materia de política juvenil
