This project examines post-Brexit protection of human rights for foreigners through international and domestic politics and law. As our philosophical standpoint, we employ critical theory and analysis of foreigners protection of human rights through duality in theoretical approach: liberalism and classical realism. We analyse three systems of law with international and domestic relevance: the HRA of 1998, the European Convention of Human Rights (ECHR) and the European Charter of Fundamental Rights. Our approach is a combination of legal methodology with aspects of doctrinal- socio- and critical- legal methods. We, therefore, apply the middle range theories of constitutional liberalism and illiberal democracy to understand the system. Furthermore, as defined in the literature review, we use the ideology of nationalism to understand the Brexit tendency and furthermore the implications for especially foreigners as accessibility to the UK. We analyse the governmental and intergovernmental system and found that some human rights will be limited post Brexit specifically in relation to the opt-out of the European Union. Lastly, we conclude that extra precautions concerning the protection of fundamental human rights must be taken as the current political climate is indicating further limits in human rights protection in the UK
