The tendency of the constant growth of condominiums more and more complete,
presents the question of living in community, besides the purpose of office or
commerce very common in the big urban centers. In order to have a peaceful and
harmonious coexistence, we will recommend a guideline capable of solving or
minimizing these obstacles among residents, in search of a better relationship,
collaborating for the well-being of these people. In this scenario, we will analyze the
relationship of the institute of incentive to the payment of the condominial fees,
through discounts in the quota party to those who pay until the expiration date with
the fine for delinquency, intending to study the legality (or illegality) of this practice.
Therefore, through this qualitative research of bibliographic survey, we will discuss
and differentiate the concepts defined in current legislation, such as the New Civil
Code of 2002.A tendência do crescimento constante dos condomínios edilícios cada vez mais
completos, apresenta a questão do morar em coletividade, além da finalidade de
escritório ou comércio muito comum nos grandes centros urbanos. Afim de que se
tenha uma convivência pacífica e harmônica, recomendaremos uma diretriz capaz
de solucionar ou minimizar esses obstáculos entre moradores, em busca de um
melhor relacionamento, colaborando para o bem-estar dessas pessoas. Nesse
cenário, analisaremos a relação do instituto de incentivo à adimplência nos
pagamentos das taxas condominiais, através de descontos na cota-parte aos que
pagarem até a data do vencimento com a multa por inadimplência, pretendendo
estudar a legalidade (ou ilegalidade) desta prática. Para tanto, por meio desta
pesquisa qualitativa de levantamento bibliográfico, discutiremos e diferenciaremos os
conceitos definidos na legislação vigente, como o Novo Código Civil de 2002
