Water rights and multiple water uses: framework and application to Kirindi Oya irrigation system, Sri Lanka
The growing attention to water rights in recent years reflects the increasing scarcity and competition for this vital resource. Because rights are at the heart of any water allocation system, they are also critical for any reallocation. Not only efficiency, but also fundamental issues of equity are at stake. To understand water rights requires going beyond formal statutory law (which may or may not be followed), to look at the many bases for claiming water. Because of the vital nature of this resource, state law, religious law, customary law and local norms all have something to say in defining water rights. The delineation of water rights is further complicated when we take into consideration multiple uses (irrigation, domestic, fishing, livestock, industries, etc.) as well as multiple users (different villages, groups of farmers in the head and tail, fishermen, cattle owners, etc.) of the resource. These overlapping uses bring in different government agencies, as well as different sets of norms and rules related to water. This paper provides a framework for examining the statutory and customary water rights of multiple users of water and applies it in the Kirindi Oya irrigation system in Sri Lanka, based on a multidisciplinary study conducted in 1997-1998. It demonstrates that the range of stakeholders with an interest in water resources of an irrigation system go far beyond the owners and cultivators of irrigated fields. Water markets in Pakistan: participation and productivity
Water markets provide one of the most promising institutional mechanisms for increasing access to irrigation from groundwater, particularly for tenants and small farmers. While water markets are found in all provinces of Pakistan, they are most prevalent in canal irrigated areas of Punjab and in NWFP. Performance of Groundwater Markets in Pakistan
Irrigation provides crucial water for agricultural production
on over 80 percent of the gross cropped area in Pakistan. Most of this
irrigation comes through public canal systems, but groundwater has
become a crucial input, both as a sole source of irrigation and as a
supplement to surface irrigation in canal irrigation commands. However,
ownership of private tubewells is concentrated among large farmers: 70
percent of all tubewells are owned by farmers with over 12.5 acres and
half are owned by farmers with over 25 acres, which seems "to point
toward an adverse effect of private tubewells on income distribution
within agriculture" [World Bank (1984), p. 35]. Institutional
arrangements are needed to spread access to groundwater to other
farmers, to increase agricultural productivity and improve equity in the
use of irrigation water resources without overcapitalisation of
agriculture. Water m~kets provide one of the most promising
institutional mechanisms for increasing access to irrigation from
private groundwater, for providing vertical drainage, and for increasing
the efficiency of water use in irrigation systems see Rosegrant and
Binswanger (1992). While such markets are not formalised or officially
recognised, the sale of water from private tubewells is a growing form
of private irrigation development. I This paper examines the nature and
operation of markets for groundwater in Pakistan. It deals with the
extent of water market development, who participates, and the effect of
purchased irrigation on the productivity of irrigated agriculture. It

Assessing the impact of agricultural research on poverty using the sustainable livelihoods framework.
As the goals of international agricultural research move beyond increasing food production to the broader aims of reducing poverty, both agricultural research and studies of its impact become more complex. Yet examining the magnitude and mechanisms through which different types of agricultural research are able to help the poor is essential, not only to evaluate claims for continued funding of such research, but more importantly, to guide future research in ways that will make the greatest contribution to poverty reduction. This paper reports on the approach used in a multicountry study of the poverty impact of research programs under the Consultative Group on International Agricultural Research (CGIAR). The studies use an expanded understanding of poverty that goes beyond income- or consumption-based headcounts or severity measures, to consider many other factors that poor people in different contexts define as contributing to their vulnerability, poverty, and well-being. The sustainable livelihoods framework provides a common conceptual approach to examining the ways in which agricultural research and technologies fit (or sometimes do not fit) into the livelihood strategies of households or individuals with different types of assets and other resources, strategies that often involve multiple activities undertaken at different times of the year. This paper reports on the conceptual framework, methods, and findings to date of these studies. Collective action, property rights, and devolution of natural resource management: exchange of knowledge and implications for policy
Policies to devolve responsibility for natural resource management to local bodies have become widespread in the past 20 years. Although the theoretical advantages of user management have been convincing and the impetus for devolution policies strong, the actual outcomes of devolution programs in various sectors and countries have been mixed. This paper summarizes key research findings on factors that contribute to effective devolution programs in the forestry, fisheries, irrigation, and rangelands sectors, which were presented and discussed at an international Policy Workshop on Property Rights, Collective Action and Devolution of Natural Resource Management, June 21-25, 1999, in Puerto Azul, the Philippines. We begin by addressing the language of devolution in an effort to clarify concepts and terminology that enable a more productive discussion of the issues. This is followed by some of the key arguments made by the workshop participants for devolving rights to resources to local users. Policies and factors that have the potential to strengthen or constrain devolution are addressed at a broad level before looking specifically at how property rights and collective action institutions can shape devolution outcomes. Whereas some factors cut across resource sectors and regions, others are more specific to their contexts. In all cases, proponents of devolution of rights to resource users struggle to understand better what elements facilitate collective action and what factors hinder its creation and sustainability. Finally, a set of recommended frameworks formulated by the workshop participants highlight the potential for fostering a devolution process that leads to the simultaneous improvement of natural resource management and the livelihoods of the poor.Devolution,

Local organizations for natural resource management: lessons from theoretical and empirical literature
The sustainability of natural resource management depends not only on appropriate technology and prices, but also upon the institutions involved in resource management at the local level. This discussion paper aims to identify factors which condition local organization for resource management. It draws upon a review of two major bodies of literature: empirical analyses of forestry, fisheries, grazing, and irrigation management, and game theory literature. The empirical literature on resource management highlights the physical and technical characteristics of the resource, the characteristics of the group of users, and the attributes of institutional arrangements as key factors affecting the management capacity of local organizations. Simplistic game theory has often been used to predict a "tragedy of the commons" for natural resources, but more refined versions provide insights into the role of communication, group size, time horizons, trust, and social norms in supporting collective action. The evidence on voluntary organization indicates that collective management is often a viable alternative to nationalization or privatization of natural resources. Although local organizations will not be able to solve every collective action problem, in many situations they could be at least as effective as other management agencies.
