The study attempts to present an abnormality in the Romanian system of expertise.I will pass in review the normative documents that regulate the medical-legal expert’sactivity and those that organize the activity of the judicial expert in medicine, ascertaining adifferent way of approaching the two kinds of expertise, especially the criminal one, by thebodies with judicial responsibilities. In the end, there are solutions advanced with a view tonormalizing the situation
