Over de âobjectvrijstellingâ en de klok van de interne markt
Inleiding: Per 1 januari 2012 geldt voor binnenlands vennootschapsbelastingplichtigen de âobjectvrijstelling voor buitenlandse ondernemingswinstenâ.3 Deze methode ter voorkoming van internationaal juridische dubbele belasting vervangt de belastingvrijstellingsmethode voor actieve winst uit buitenlandse onderneming in de vennootschapsbelastingsfeer. Dit om te komen tot een meer gelijke fiscale behandeling van binnenlands vennootschapsbelastingplichtigen, die op directe wijze (âvaste inrichtingâ) of op indirecte wijze (âdeelnemingâ) in het buitenland ondernemingsactiviteiten verrichten.4 EĂ©n van de geĂŻntroduceerde effecten is dat het fiscaal in aanmerking nemen van lopende reĂ«le verliezen uit een buitenlandse onderneming, gedreven met behulp van een in het buitenland gelegen vaste inrichting, niet langer is toegestaan. Impliciet rechtvaardigt de wetgever zijn systeemwijziging met de constatering dat de voorheen onder de belastingvrijstelling mogelijke tijdelijke fiscale verliesimport een âtimingvoordeelâ betreft. Deze woordkeuze verraadt een normatieve overweging. We schrappen een âvoordeelâ en komen zo tot een heffingssystematiek, op dit punt, zonder anomalieĂ«n. De wetgever suggereert een verbetering. Maar is daar wel sprake van? Heeft de wetgever niet eigenlijk gewoon een nadeel gecreĂ«erd? En daarmee de klok van de interne markt teruggedraaid?

The Meaning of Avoidance and Aggressive Tax Planning and the BEPS Initiative
This national report has been prepared as a contribution to the Conference of the European Association of Tax Law Professors entitled âTax Avoidance Revisited: Exploring the Boundaries of Anti-Avoidance Rules in the EU BEPS Context. The conference is to be held in Munich, Germany, on 2-4 June 2016. The national report â quite comprehensively â deals with the phenomena of tax avoidance and tax planning by multinationals and the addressing of these in the Netherlandsâ corporation tax system. Topics addressed include:
