    Application of the Rule against Perpetuities to Powers of Appointment: Ohio Style

    Of all the instruments available to a donor wishing to transfer property, none has the versatility of the power of appointment. The transfer of legal title to property combined with the creation of a power of appointment rids the donor of ownership of the property and provides the donee of the power with the flexibility to apportion the property in accordance with future needs and events arising long after the time of such transfer. This flexibility is often unavailable even in a carefully drafted trust which does not contain powers of appointment. A trustee with power to invade principal or to spray income among a class of beneficiaries can control somewhat the eventual distribution, but the identity of the beneficiaries must be definite, at least as to such class, or the trust will fail for lack of a cestui que trust. This is not the case with a power of appointment. The donor of a power can postpone until well after his death a final determination of both the amount of the gift and the identity of the recipient. The outcome of future events can thus be taken into consideration before ownership finally vests

    Intranasal ciclesonide for allergic rhinitis

    Ciclesonide is a novel corticosteroid which is optimized for topical use. It is a pro-drug which is activated locally in the airway mucosa, lipid-conjugated for local retention, and has very high protein binding in circulation leading to low systemic bioavailability. These characteristics should lead to highly selective activity with reduced local and systemic side effects. It has been established as an inhaled medication for asthma and has also been shown in double-blind trials to be efficacious for the treatment of seasonal and perennial allergic rhinitis. However no data have yet demonstrated superiority over existing nasal topical corticosteroids, either in terms of efficacy or adverse effects, and trials have not yet clearly shown efficacy in rhinitis in children. Therefore the place of ciclesonide in the treatment of allergic rhinitis relative to other existing products remains unclear

    Evaporation and growth of crystals - propagation of step density compression waves at vicinal surfaces

    We studied the step dynamics during crystal sublimation and growth in the limit of fast surface diffusion and slow kinetics of atom attachment-detachment at the steps. For this limit we formulate a model free of the quasi-static approximation in the calculation of the adatom concentration on the terraces at the crystal surface. Such a model provides a relatively simple way to study the linear stability of a step train in a presence of step-step repulsion and an absence of destabilizing factors (as Schwoebel effect, surface electromigration etc.). The central result is that a critical velocity of the steps in the train exists which separates the stability and instability regimes. When the step velocity exceeds its critical value the plot of these trajectories manifests clear space and time periodicity (step density compression waves propagate on the vicinal surface). This ordered motion of the steps is preceded by a relatively short transition period of disordered step dynamics.Comment: 18 pages, 6 figure

    Population of 13Be in a Nucleon Exchange Reaction

    The neutron-unbound nucleus 13Be was populated with a nucleon-exchange reaction from a 71 MeV/u secondary 13B beam. The decay energy spectrum was reconstructed using invariant mass spectroscopy based on 12Be fragments in coincidence with neutrons. The data could be described with an s-wave resonance at E = 0.73(9) MeV with a width of Gamma = 1.98(34) MeV and a d-wave resonance at E = 2.56(13) MeV with a width of Gamma = 2.29(73) MeV. The observed spectral shape is consistent with previous one-proton removal reaction measurements from 14B.Comment: Published in Phys. Rev.
