As shown by the author in an earlier case note, (Church âJerrier v
Outsurance Insurance Company Ltd The duty to disclose: An ongoing
problem?â 2013 De Jure 859), the case of Jerrier v Outsurance Insurance
Company Ltd (2013 JDR 0562 (KZP) (Jerrier a quo)) highlights the fact that
the duty to disclose is still problematic. A concern highlighted in the note,
was the fact, as a result of this decision, that short term insurers believed
the judgment to mean that consumers are obliged to report to their
insurers every minor incident, such as driving through a pothole or a
scratch on their car, even where they elect not to lodge a claim for the
resultant damage â failing which, their insurance claims might be
rejected. This interpretation, in the opinion of the author was incorrect

It is a trite principle of the law of contract that a condition is an uncertain future
event upon which either the commencement of the duty to perform or the contractâs
continued existence is made dependent. The effect of a suspensive condition
can be summarised as follows (see Otto and Prozesky-Kuschke âGeneral
principles of the law of contractâ in Nagel (ed) Commercial law (2011)
114â115): A condition is suspensive when the right or duty to performance in
terms of a contract is suspended or postponed pending (and thus made dependent
upon) the occurrence or non-occurrence of an uncertain future event specified in
the contract. Pending the fulfilment of the condition, a contractual relationship
indeed exists between the parties. One of the consequences of the existence of a
contractual relationship is that neither party can withdraw from the contract and
that any additional duty must be performed. Upon fulfilment of the condition, the
parties are entitled to performance and obliged to perform. Before fulfilment,
performance may not be claimed. If the condition is not fulfilled, the contract is
terminated and neither party has to perform. In addition, either party is entitled to

RECONSIDERING AN UNDERSTANDING OF DAMAGES AS A SURROGATE OF SPECIFIC PERFORMANCE IN SOUTH AFRICAN LAW OF CONTRACT
The South African law of contract provides three broad types of remedies in the event of breach of contract: Remedies aimed at keeping the contract alive;Remedies aimed at cancelling the agreement; andRemedies aimed at compensating the innocent party for loss or harm caused by the breach.The claim for contractual damages is a remedy in the third category serving a compensatory function in the law of contract as a matter of corrective justice. The jurisprudential underpinning and reason for its grant have been a prominent issue in contract law theory and have been explored and analysed in depth.For instance Fuller and Perdue's seminal work The Reliance Interest in Contract Damages provides a distinctive purposive understanding of contract theory through its compensatory function in the form of contractual damages. But a topic often less explored or considered is the underpinning of an order of specific performance, being a remedy of the first category above in upholding and enforcing the contract
Lesungen fĂŒr Segnungsfeiern gleichgeschlechtlicher Paare, queer ausgelegt. : Jonathans Zusage der Lebensgemeinschaft an David (1 Sam 18,1-4) und Ruths Treueschwur gegenĂŒber Noomi (Ruth 1,14-17)
(1) In den biblischen Kontexten von 1 Sam 18,1-4 und Ruth 1,14-17 kommen keine reinen Paarbeziehungen, sondern nur Mehrfachbeziehungen vor. Das verweist auf ein VerstĂ€ndnis von Ehe und Hochzeit, welches sich von unserem heutigen unterscheidet. (2) In der ersten Begegnung zwischen David und Jonathan in 1 Sam 18,1-4, der Lesung fĂŒr ein MĂ€nnerpaar, sagt Jonathan David (ein Name, der nicht anderes als "der Geliebte" bedeutet) seine Lebensgemeinschaft zu. Gleichzeitig mit Jonathans wiederholter Liebesbekundung an David nimmt König Saul diesen schönen, im Kampf erfolgreichen JĂŒngling zu sich und lĂ€sst ihn nicht wieder ins Haus seines Vaters zurĂŒckkehren. David könnte deshalb mit einer neu verheirateten Braut verglichen werden, die in den Haushalt ihres Ehemanns einzieht. (3) Sprechende Namen unterstĂŒtzen eine queere Interpretation der Lesung Ruth 1,14-17 fĂŒr ein Frauenpaar: Aus damaliger wie heutiger Sicht kann nicht ausgeschlossen werden, dass die Beziehung Ruths, "der Freund_in", zu Noomi, der "Lustvollen", als erotisch motiviert verstanden wird: Ruth hĂ€ngt sich in Ruth 1,14 fest an ihre Schwiegermutter an und schwört Noomi in Ruth 1,16-17 lebenslange Treue. Ăhnliche Formulierungen im Buch Ruth und im zweiten Schöpfungsbericht legen aus queerer Sicht ein eheĂ€hnliches VerhĂ€ltnis zwischen Ruth und Noomi nahe. (1) In the biblical contexts both of 1 Sam 18:1-4 and of Ruth 1:14-17 we do not find pure partner relationships but multiple relationships. This suggests an understanding of marriage and wedding that differs from our present-day notions. (2) In the first encounter between David and Jonathan in 1 Sam 18:1-4 â the reading for a male couple â Jonathan pledges life partnership to David (a name that means nothing but "the beloved"). Simultaneously with Jonathan's repeated expressions of affection for David, King Saul takes this beautiful young man, victorious in battle, home and does not allow him to return to his fatherÊŒs house. This is why David might be compared to a newly married bride who moves into the household of her spouse. (3) The telling names sustain a queer interpretation of the reading Ruth 1:14-17 for a female couple: From both a biblical and a present-day perspective it cannot be ruled out that the relationship between Ruth, "the girlfriend", and Naomi, "the sweetheart", is understood as erotically motivated: besides clinging to her mother-in-law in Ruth 1:14, Ruth swears lifelong fidelity to Naomi in Ruth 1:16-17. Parallel formulations in the Book of Ruth and the second creation account suggest a quasi-marital relationship between Ruth and Naomi from a queer perspective
Wet op onderverdeling van landbougrond, opsies om te koop en verbandhoudende aangeleenthede
Hierdie bydrae toon aan hoe die Wet op Onderverdeling van Landbougrond in die 45-
jarige bestaan daarvan tot magdom beslissings aanleiding gegee het en hoe die tersaaklike
bepalings daarvan oor die jarige gewysig is om by veranderende tye en behoeftes aan
te pas. In die besonder word aandag gegee aan die doel van die Wet en die onlangse
beslissing in Four Arrows en die implikasies wat die beslissing inhou vir opsies, voorkoopsregte,
skenkings en ruilkontrakte ten opsigte van die verdeling van landbougrond.
Die gevolgtrekking is dat die Wet so gou moontlik geskrap moet word aangesien dit meer
probleme skep as wat dit oplos. Daar word voorgestel dat die vereiste van ministeriële
toestemming vir die onderverdeling van landbougrond eerder in ander wetgewing, soos
die Registrasie van Aktes Wet 47 van 1937 en die Grondopmetingswet 8 van 1997,
