Unconstitutional Change of Government: A New Crime within the Jurisdiction of the African Criminal Court
One of the most interesting and controversial crimes that belong to the subject matter jurisdiction of the newly to be established African Criminal Chamber is undoubtedly the crime of unconstitutional change of government. This article explores the question why this offence is upgraded to the regional level of criminal law enforcement. After all, any criminalization of the conduct at a regional level and the concomitant inclusion of the offence in the jurisdiction of regional courts raises questions about the right of foreign intervention in internal political affairs and the curtailment of the right to rebel. The crime of unconstitutional change of government is tested against these principles and it is concluded that they do not impede criminalization, nor the elevation of the crime to a regional level. In search of a positive argument in defence of the inclusion of the crime within the jurisdiction of the African Court, I contend that the best explanation is that insurgencies are not contained to single states but are inclined to spread to other countries. In view of the specific African experience, where endemic conflicts have proved to be contagious, it is clear that states have a common interest in suppressing both the dynamic and static form of unconstitutional change of government
Extradition and Mutual Legal Assistance in the Draft Convention on Crimes Against Humanity
Working on crimes against humanity, the International Law Commission (ILC) has modelled its draft articles on extradition and mutual assistance on corresponding provisions of the United Nations Conventions against Corruption and Transnational Organized Crime. Nevertheless, some provisions are clearly adapted to the special nature of crimes against humanity. This article seeks to explore how the ILC has navigated between producing a flexible and general framework and adapting the system more specifically to the specificities of crimes against humanity. The ILC has been censured for easily transposing already existing regimes that were not designed for such specific contexts. On closer scrutiny, that criticism is not entirely justified. A comparison with the parallel provisions in the Statute of the International Criminal Court (ICC) reveals that the ILC’s provisions do not deviate much from the system as adopted by the ICC. This similarity may be indicative of the soundness of the ILC’s approach in construing a framework that may contribute to the improvement of interstate cooperation in the suppression of crimes against humanity
The relation between social acceptance and school well-being in early childhood
The present study investigated the relation between socialacceptance and school well-being in early childhood. Additionally,it was explored whether this relation depended ongender and age. In total, N = 311 children (aged 4–7) participated.Social acceptance was assessed with a peer nominationmethod and school wellbeing was measured with aparent questionnaire. Outcomes of hierarchical multipleregression analysis demonstrated a positive relationbetween social acceptance and school wellbeing. Regardingthe role of gender and age, outcomes indicated that socialacceptance was related to school wellbeing only for girls(not boys) and only for younger children (not older children).Implications and directions for future research arediscussed
